Why not tell them what you found out the car has no MOT and it hasn't been sold as advertised?

How will you get the car to them tomorrow to fit the part?

I honestly don't know how to say it to them, if that makes sense, I'm really no good with complaining. If it was a case of the part is going to be delivered and they will fit it and get the MOT, I will be happy and just leave it. What I don't want to do is p**s them off and get in an argument if the part has turned up incase they get funny and it further delays the work being done.

But if they are lying again then I will be going in on Saturday and I will tell them I know about the MOT/tax ect, and demanding a refund

With regards to getting the car there; the car technically has an MOT from march, the only thing it doesn't have is tax, and the garage is only 1 mile from me down back roads. I know I shouldn't drive it untaxed but 1 mile shouldn't hurt?

When you phone them to see if the part is in; if it is and they tell you to come down. Ask them if they're going to re-MOT it after fitting it as you've spoken to VOSA and they've told you it failed on the SRS light.
At that point, they'll probably umm and ah and then say yes. So you'll be driving it to a pre-booked MOT.

Ok thanks, that sounds like a good way of wording it.

i've just rang the garage to chase up the airbag part.

They told me its due in at 11am tomorrow, again this could be a lie, but I will wait until 12 tomorrow, ring them, and if its still not there take the car back saturday to try and get a refund, I would rather not do it this way as like many of you have said its not easy and there's no guarentee they will pay up, even if taken to court.

If they are telling the truth and the part is going to be delivered tomorrow, I will give them a chance. I'm thinking that they might be planning on fitting the part and then doing the MOT, hoping I would never find out they lied to start with. They don't know that I know they are lying.

Of course I might be wrong and they could be lying about the part
Ask them what the part number is and check it out yourself. If they will not tell you would get (more) suspicious.

Here is what I have. Do I have the correct documents?
What do I have to send off?
And from a legal point of view do I own the car with this paperwork?

    Thanks

You have the right one for your old car but if you look at the new one you'll see that the seller should send that off so they shouldn't have given it to you.

If you don't have the new keeper part then once that goes in the post, you won't have any proof that it is your car.

Given the DVLA couldn't find their backsides with both hands and a map, make sure you send it off recorded delivery so you can prove they have it. Take a copy/scan too so you can refer back to it if needed!

That's assuming you keep the car and don't go for a refund of course. Might not be worth registering if you do that.
What if there was no such thing as a rhetorical question?

You're right. Do you know when that was added in? I used to lurk around a lot on MOT Inspector forums but a few months ago (3-4) that SRS bulb being removed wasn't a reason for failure

March 21st 2013 if my memory serves me right. Previously an illuminated SRS light was an express advisory item (as opposed to an !!!-covering advisory) but is now a testable item.

No, he's got the correct part of the V5 for the new car too. It's the second page, with the V5C/2. The front page with new keeper's details which should be sent to Swansea is missing.

That's right. The fact it is the full page threw me off. Note to self, look more carefully at the pic next time.

Seems like they have managed to do one thing properly!
