Need help with car dealer lies

    Do you think the best way to do it is to work out how much the repairs will cost me, and then claim for that amount?

    I bought a car from these cowboys 30th October 2013.
    Stanley Rudgely - Woolston Car Supermarket.
    Companies house shows Mr Rudgely as the director of this company from 17 Oct 2013. Before the date I bought the vehicle.

    After hearing the car running and bad noises coming from the engine area I told them I was unhappy and wanted my money back.

    The refused, point blank...

    Said they would fix the problem (noisy manifold cover, they said!) and get a new MOT on the vehicle.

    Two days later when I went to collect it after it getting a new MOT I took it for a test drive and it had the same fault that I was not happy about, they hadn't fixed it.

    Again I repeatedly asked for my money back, they refused.

    I refused to take the vehicle and left it with them.

    I contacted a local Peugeot Dealership to run a diagnostics test on the car (£45) to see what was wrong, told the 'cowboys' that I had booked it in and would they take it to the diagnostics.
    They agreed and I waited to hear from Peugeot.

    Heard from Peugeot saying that the dual mass flywheel and other issues were found with the vehicle. Contacted Woolston Car Supermarket and told them I was refusing the vehicle and would they collect it. They said that they already had...


    A week later I get a call from Peugeot Hamble to ask when I am picking my car up. Explain to them that the 'cowboys' had told me they already had and that I refused the car from them. They said I had 3 days to move it off their forecourt or they would put it out on the road...! (No insurance, car in my name!) I did not want this in case it was damaged/stolen, so asked if they could deliver it to me, which they did.

    I contacted Woolston Car Supermarket by letter informing them that I would be taking them to court unless they accepted this final chance offer to refund me. No reply.

    Small claim sent off, judged in my favour.
    Warrant applied for and granted.

    Contacted bailiff in Southampton court regarding the serving of the warrant and he said he could not act on it due to the fact that the defendant was 'Woolston Car Supermarket' and not a limited company, he could not act on a business name alone.

    So I sent a N244 form to small claims asking for an ammendment on judgement and warrant to read 'Woolston Car Supermarket Ltd', but received a letter today saying that I did not apply for the ammendment correctly....

    I would like to get this resolved, but unfortunately things have taken a turn for the worse. Woolston Car Supermarket Ltd no longer trade in Southampton and have now moved site to Fareham where they are trading under the name 'Fort Wallington Car Sales'.

    I do not know where to go from here....!!!

    Is it possible for me to continue my current claim, do I change the defendants' name to the new company name and address?

    No listing on companies house register for 'Fort Wallington Car Sales', so I do not know who the director is...

    Lots of other people in the same situation as me, I learned, after speaking to the court bailiff today...

    Seriously screwing after being ripped off by these people.

    £2300 down on the car
    £45 down on Peugeot diagnostics
    £100 down on court claim
    £40 down on warrant application
    £45 down on ammendment application...


    No one is giving any advice on what I should do. Solicitors want £90 for a 30 minute initial consultation. Legal aid has been withdrawn for this, apparently!!!!

    At what point do I give up and let them win? I can't afford to keep throwing money at the legal costs as these cowboys change name and address as they please and are completely dodgy!

    AVOID AT ALL COSTS!!!!

    I hope my horror story helps others not fall for crap motor from these gits...

    any advice for me, more than welcome....

  • This is why it's important to take action quickly, car dealers are very good at delaying tactics. Don't give them time.

    For some reason they do seem to get away with it though, almost as if the laws don't apply to them.

    And again another example of car dealers ripping people off, and the good ones wonder why we dont trust them
