He should have a green slip and a yellow slip - not a full V5 and a green slip

Agreed. If he did, he'd have them the wrong way round :)
What if there was no such thing as a rhetorical question?

If the car is no current keeper, the OP is in really hot water if he drives it.
The police will stop it and do the full mash, driving not in accordance with licence (keeper change) no Excise licence, and call his insurance from the road side and have a go at getting it cancelled over the keeper issue (Away on a flat bed to the pound) .

The OP needs to separate off the legal responsibilities from the dealer dispute and very quickly, the traffic police do not do excuses.

The chances of him getting anything back from the dealer are slim to nothing, even CCJ's tend to get put in the drawer with all the rest.
    Be happy...;)

When I get home today I will confirm for definite exactly what paperwork I have on me. Would you then be able to advise me if it is correct, and what I need to send off in order to put the car in my name?

At the moment I am not driving the car as it has no tax, and it is being kept on private property.

Airbag light on is a fail. Remove the bulb, and the light won't come on then it becomes a pass.

Actually, no - testing manual section 5.4 says that an inoperative SRS warning lamp is a fail.

Remove bulb = inoperative lamp = fail.
  • I've just spoke to a mobile mechanic. its £30 for them to come out to diagnose the error. Do you think its worth me doing this?

Why is this allowed to happen? If I did something illegal I would expect to get in trouble, yet these dealerships seem to rip people off all the time and pretty much get away with it

As you haven't battered up the motorway to get the money back that is rightfully yours, I'm going to hazard a guess that he has convinced you that you've done him over; got the new car too cheap and got too much for the clunker you've chopped in.

Because the only way to get 'justice' is to take the dealer to court yourself and fight it out there.

Generally speaking the judge will rule in favour of the buyer, but then you run the risk of the trader not paying up anyway OR folding the business and started another ltd company.

Its a total minefield for customers and for traders who are trying to do things right - you end up having to compete on price with the minority who dont give a monkey and who dont stand over their cars.

You're right. Do you know when that was added in? I used to lurk around a lot on MOT Inspector forums but a few months ago (3-4) that SRS bulb being removed wasn't a reason for failure

    No.
If they did or didn't find the fault, you're still in the same position. You don't have a product that matches what was advertised (i.e 12 months MOT)
Reject the car, request a full refund.
If they refuse, and can't repair the vehicle promptly i'd contact trading standards and then consider starting small claims proceedings.

  • i've just rang the garage to chase up the airbag part.

They told me its due in at 11am tomorrow, again this could be a lie, but I will wait until 12 tomorrow, ring them, and if its still not there take the car back saturday to try and get a refund, I would rather not do it this way as like many of you have said its not easy and there's no guarentee they will pay up, even if taken to court.

If they are telling the truth and the part is going to be delivered tomorrow, I will give them a chance. I'm thinking that they might be planning on fitting the part and then doing the MOT, hoping I would never find out they lied to start with. They don't know that I know they are lying.

Of course I might be wrong and they could be lying about the part
