PE has a legal obligation to make reasonable adjustments for disabled people under the Equality Act 2010. A reasonable adjustment would include allowing longer time for someone with mobility problems to get from their car to the shop, get round the shop to do their shopping, including allowing time to rest where necessary, and return to their car, instead of imposing arbitrary time limits which a disabled person would have more difficulty than an able bodied person in meeting. Interestingly, having been put on notice of this poster's disability and consequent mobility difficulties, PE subsequently cancelled one of the charges at the request of the landowner, but then went on to issue further charges - despite being fully aware of her disability and hence their obligations.

I believe we are all on the same side - petty squabbling is not going to help any of us and on Lainee's thread would be disrespectful to her, so I will stick to the subject.
I have already set out the case in post 153 and Daisy has spelled out the legal context above. The only "offence" Lainee is guilty of, is being a slow shopper. She didn't take up two spaces, didn't take a disabled spot she wasn't entitled to, didn't park outside a space, she didn't even committ the heinous crime of parking with a wheel over the white line. She caused no inconvenience and certainly no loss to anyone. She even paid PE's first demand for her money before the forum regulars and Benefits Master in particular came to her rescue.

I agree SevenTowers, Lainiee has done absolutely nothing wrong in any of the 3 instances.
She appealed the first one 18 months ago and PE told her to pay it anyway as she had no Blue badge. She paid as she believed them & felt she had no option.
Then she ignored the second one (having sussed them a bit) and that one was subsequently cancelled during the court proceedings of this third one - regarding which the Range had TAKEN the court papers from her at the CS desk and said they WOULD CANCEL.
They didn't, the Range are culpable too as they knew about her disability as well. PE knew about her medical condition 18 months ago and Lainiee still has the emails. PE had plenty of chances to add her car reg to a white list.
PE ended up having the CCJ set aside at no cost to her and are now facing a counter claim. GOOD!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I am grateful to those fighting my corner..thankyou.
I would just like to point out that on my next birthday in August I will be 43.. not quite a pensioner...even tho my body may feel like it every day! lol
I should never have been issued a PCN at the range! Its correct that I did not use a disabled bay, also that it took me much longer to shop, I'd spent over £50 on that visit, if it had not been for a store wide system failure with the tills. I would NOT have over stayed the alloted time given to all shoppers. Or what should have been double time in my case given the Range & PE knew of my mobility problems!
As to the first PCN 18 mths ago, yes I do have the emails telling them the circumstances, my mobility & various other medical problems, I had paid to park, but inadvertently overstayed due to being in alot of pain & feeling very ill... they refused my appeal because I didnt have a blue badge! & so not knowing what to do about that & feeling totally that they didnt give a toss about my mobility problems, I paid the fine!
I should not have got one for Aldi either as I probably would have made it out the car park had it not been for the large ques & incompetent lady at the tills who didnt know what to do with the coupons I had... my 80 £ shopping had to be scanned 3 times! & eventually the manager had to take over.
So to those flaming me saying i flounted the law etc.. Am I responsible for have mobility, mental health, memory, anxiety problems? Fibromyalgia, hypothyroidism, diabetes, athsma.. the extreme pain I suffer with daily & the concoction of pills I have to take 2-3 times a day which in themselves also cause problems. I'd like to say, if you have nothing supportive, constructive or helpful to add then don't add anything at all! But there will always be those in their ivory towers that gloat at others, won't there! They arent the ones who are suffering with pain & mobility & several other issues on a daily basis!
So thats ok then huh...lol0 -
Hello lainieee, I'm happy that you have had things sorted for you with the help of people on here, it was disgusting what happened to you and parking eye should be ashamed of themselves.
As for people flaming you, I don't think its a deliberate attempt to discredit you but a general discussion on situations like this, the fact is people look at things differently and we do have disagreements on here. I'm sure the people that appear to flame you will feel aghast that you feel that way.
I hope you take comfort in the fact that we are all here to help you, and we were all extremely pleased that you had some justice in getting things sorted. I hope your health improves as I can't imagine what's it like to have that ails you, I know it's just words on that side of things, but as someone who has diabetes myself I know in some small way what you are going through.

There is only one person doing this Lainieee, and that's a person who regularly demonstrates that his only purpose for being here is to massage his own ego by pontificating about how much property he owns and how he used to negotiate international treaties.

SevenTowers, I am glad we have cleared that up, as a former diplomat, I always chose my words very carefully.
Iainiee, I am not flaming you, I agree with everyone else that you have been treated appallingly. Your biggest sin, if one can call it that, is trusting people. Having spent many years in Nigeria and India, I trust very few people, and like to have everything in writing.
When I read one of your posts where you mentioned your little girl, I realised that you were probably not a pensioner and am surprised that so many on here thought that you were. I hope that they did not use this to support your case, but rather suspect that they did.
The fact is, actions have consequences, in your case it was inaction, why did you ignore County Court papers, you have never properly explained this.
I agree with everything said by others in your support, but I do think that you are not entirely unresponsible for the situation which brought you here, and hope that it has been a learning experience.You never know how far you can go until you go too far.0 -
The Deep although it seems simple that you don't ignore a CCC I can tell you this as a fellow sufferer with Fibromyalgia, arthritis and other medical conditions, in my worst periods, I could easily miss a nuclear attack!
Also it wasn't long ago ignoring everything was the norm, of course CCC's were a different matter, but Lainiee wouldn't be the first to ignore one.0
