You can take your choice - your ticket, your problem. No one here can absolutely predict 'what happens next', but PE are the most litigious of all PPCs. The fact you've heard nothing for 6 months is, frankly, a bit strange; PE are pretty efficient in chasing.

You have until formal court papers are issued to name the driver - after that, you're on your own. You can take the gamble that nothing more will happen, and that's possibly the end of it (but don't forget that these things can be legitimately chased up for 6 years following the event).

Or, you can name the driver and they can go to POPLA, and with guidance from the forum, virtually guarantee success, with no further 'uncertainty' for the next 6 years.

It's a gamble that only you can decide upon.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

OK, OK. Don't get me wrong, I'm happy to take advice. I can get the letter off tomorrow. My partner is already being treated for stress and is on medication for it and although she doesn't need this, hopefully I can protect her from it.

Is says: Now - final, but IMPORTANT points.

    * Never say who might or might not have been the driver on the day - there is no obligation on you to do so (some PPCs will ask you to name the driver/motorist before they can deal with your appeal - DO NOT comply with their wishes). In any correspondence with the PPC, always refer to the driver in the third person, never say 'I didn't see the signs' or 'my wife didn't see the signs', you say 'the driver didn't see the signs'.

Does anyone know where I can find a suitable template for a letter to send to Aldi? I haven't found one yet. I don't have a receipt as it was so long ago and I can't prove anything with bank statements either as I always pay cash for my shopping (and my fuel).

These are all issues for dealing with the PCN at the initial stages, when the RK has the opportunity to appeal. You've passed the point of appeal as the RK.

Sorry to hear about your partner's health problems, but there's no need to involve them in this, it's just a case of naming your partner as the driver, after which any correspondence will be in their name, but YOU can deal with it; just put your partner's name at the end of any correspondence between them and the PPC - and sign it with a squiggle (identity protection - you don't want these outfits seeing any genuine signature).

If you would just please read what's under your nose, you'd find what you need. Just above your post earlier I had told you in October to name the driver and I even told you which thread to look on to find a template letter. And yet you missed that completely and seem surprised we are saying it again in December?!

Now you are asking for a 'template complaint letter for a store'...on a forum where one of the obvious sticky (info) threads at the top is called 'successful complaints about PPCs' and where a permanent thread on page one/two is the 'Aldi Facebook kicking off' complaint thread. Do you come here and ONLY look at your own thread or something?!

If you would just read what's here in your thread already and read the sticky threads and other relevant ones like the Aldi Facebook one, you'd be halfway there.

Also clearly you could easily give a different address for service for the driver, to protect her (e.g. her name and your family's address or your work address). As long as it's somewhere that knows to pass the letters to you to handle for her, not a workplace that would return the letter or something daft!

Oh yes, sorry, life isn't easy when you're suffering with depression.

Shall I tweak that and post here or just get it off to Aldi?

Tweak what? There are lots of examples of complaints in the successful complaints sticky thread. Including ones where the driver and/or keeper are covered by the Equality Act 2010 (which it sounds like you BOTH are). Or just have a look at the Aldi Facebook thread and post a facebook complaint or email asap, or go into the shop and complain to the Store Manager in person, which is much easier than writing a letter.

I meant the one that you referenced above, or shall I just tweak it and get it off to Aldi?

Is it OK to tell Aldi who the driver was?

Should I email or send it?

I don't know which one you mean, when talking about complaints letters for Aldi I referenced a whole thread or two...

The only actual letter referenced was the 'naming the driver' letter to send to the PPC, which also features in a thread today. It really does help you if you read other threads:

    https://forums.moneysavingexpert.com/discussion/4842085

Use that letter for the PPC, yes, with a different address if you can get post there.

And as for the complaint to Aldi, what about changing this one to suit, which I wrote ages ago on pepipoo (post #13):

I post as SchoolRunMum on that forum.
