Why are you showing us the old PE 'news' item we've seen loads of times since September, when there's all the PE cases since then, won by the motorists?

Much more interesting to read about. :)

I just thought I'd refer to what they're claiming on their website. I'm not suprised that you've seen it

OK I have a reply from Aldi. If I can provide proof of purchase, they can cancel the parking charge. The parking charge has been temporarily suspendedpending further contact from me.

No mention of the equality act

Sounds good, if you have a receipt or relevant Bank statement then do so.

Get back in touch with ALDi and tell them that you paid in cash, and have no receipts, Tell them that this charge amounts to an unlawful penalty that through their agents, parking eye Aldi are trying to impose on you, and that you aer now instructing them to cancel this action by their agents, parking eye, for whose actions they are liable for and responsible for.

If they fob you off again, Stroma wrote this to send to parking eye,
    Dear Parking Eye

In reference to your two letters sent to the Registered Keeper dated xx/xx/xx. I have informed your company that this is being handled by the Registered Keeper of the vehicle, this is the legal right to do so under pofa 2012 as you are well aware.

The appeal has been sent, there is nothing further to add to it, you again asking for information is not going to be forwarded to you. So you have two choices either accept the appeal, or reject it and send the popla verification code so an appeal to them can be made.

Your delaying tactics are being reported to the BPA and DVLA, you are in breach of the Code of Practice you supposedly have to follow. No further correspondence will be entered into.

    (add this if you wish)

If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Sincerely
I would suggest a slightly different version based on the above to send to Aldi...

Dear Aldi, in reference to my previous communication with you over the actions of your agents Parking eye (invoice xxxxxx) and all associated letters.
The challenge to this charge has been sent to you ( via your agents parking eye), and there is nothing further to add to it. Your agents, Parking eye are yet again asking for information that is not going to be forwarded to them.

You now have two choices either cancel this ridiculous charge, or continue with allowing your agents parking eye to continue with this charade.
They (parkin geye ) will issue me with a POPLA verification code which i will then use so that a challenge can be made through the POPLA system.
I have reported your actions to trading standards, and I have also made a complaint about your agents parking eye, for whos actions you are responsible for to the DVLA and their trade association, the British Parking Association, limited.

Please note that should a challenge to POPLA be ruled in my favour ( lack of contract, unlawful penalty, not a genuine pre estimate of loss to Parking, eye etc etc) I must inform you that I may claim my expenses from you and/or Parking Eye I am holding you jointly liable for the actions of your agents.
The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to allow your agents to pursue me you agree to pay these costs when I prevail.

As I've also written to PE and told them who the driver is, do they have a limited time to contact the driver?

I was thinking that if I leave it a while before responsing to Aldi and in the meantime, PE don't contact the driver, might it time out?
