    Nothing is going to 'time-out' with PE (or any other PPC) where there's any sniff of cash.

    You need to be proactive; PE issue court papers, and while they are defendable, there will be much more work for you (and inevitably us) to do if these drop through your letterbox.

    Push hard now, it won't go away.

    OK so they should soon send a new Notice to that person, who can then appeal. That's what happened in my friend's case I helped him win recently and the new Notice to the driver arrived about a fortnight after he had named the driver.

    That's what I would have expected but my question was whether they might not do that while the PCN is on hold

    They might now, so give PE (and Aldi if you like) a ranting nudge, i.e. there are no receipts available because the driver pays cash when shopping, as they are perfectly at liberty to do. The matter should be taken up with the driver who has already been named and appears not to have been contacted so far.

    What's the rational behind chasing them? If I have written and told them who the driver is then they either forget it or send a PCN to the named driver right? I can't be taken to court if I've told them who the driver is right?

    As long as they don't say they never got that communication...

    ...my rationale is for the driver to be able to win at POPLA so there will never be any court case.

    If I've told them who the driver is though and they don't contact them then there won't be a court case anyway will there?

    What do you mean you have a POP? You have a POPLA code and haven't used it? What date?

  • Sorry if I'm interfering, but I suspect that Stonker means by a POP that they have a "proof of posting" for the letter they sent to PE telling them who the driver was.
