If they have cancelled, yet you still appeal to POPLA, PE will simply withdraw - no hassle for them, no cost to them. Pointless exercise.
Fair enough. Was hoping to be able to rub salt into the wound :)
Do you have Aldi's agreement to cancellation in writing?
    In a Facebook PM.
I'll check on PE, as you say.

    Many thanks.

  • I recently received a fine from Parking Eye for stating 12 minutes too long in ASDA car park... It really annoyed me because I had no idea that ANPR was used and that it was timed to the second! I think Parking Eye is a scam set up to catch people out on purpose because it doesn't allow time to; finding a space, loading the car after shopping and doesn't account for long check out queues. Plus you never look at the exact time until you are parked and heading into the supermarket,

Anyway I contacted ASDA Service team on Twitter based on the recommendations of this forum and after sending my receipt and parking notice to the team have now had it cancelled. I have to thank ASDA very much for this and urge more people to complaint so that companies like Parking Eye lose contracts with big companies for scamming innocent members of the British public!

I also want to thank this fourm amongst others for helping me to successfully complain for an innocent mistake. Thanks MSE.

Well done and thanks for feedback. :T
I have to thank ASDA very much for this
At one level that's understandable, but the bigger picture provides no thanks at all for Asda, as there will be many hundreds, totally traumatised by a ticket from PE, who, not having the access to the internet you have, nor the resilience to fight this, supinely pay up because they think they've done something 'wrong'. Of course, Asda, by definition, will never know about these, but as time goes on, will be wondering why profits are sinking.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I would not thank ANY supermarket - it's their fault to let a scammer infest their sites and prey on their customers.

Cancelling it is not great by Asda, it is pathetically shutting the stable door after the 'horse' has already bolted at you, their customer, and annoyed you forever.

how about a quick email / letter to your MP stating how you feel re all this .....

read / watch the below then please concider helpinh the cause ...

and slightly longer, the committee stage

    https://www.parliamentlive.tv/Event/Index/d5550515-cce9-4185-83ec-754dadb7524a

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

and some quotes from the committe stage

"The other area is hospital parking, and I want to single out one company for some pretty shady practices. That is ParkingEye"
" is very clear to me that there is collusion between parking companies and solicitors’ firms—so-called roboclaims companies. "
"They are often set up adjacently and involve the same directors and personnel. Incidentally, the same personnel get involved in the so-called appeals bodies."
"Essentially, it is a money-making enterprise that takes advantage of motorists up and down the country. They operate in a very business-like fashion, which is why I call them roboclaims companies."
"The companies are jamming up parts of our legal system."
“I now pretty much know exactly how the parking companies and in particular the IPC have been running this scam for the past 5 years. Basically both of the appeals processes are a complete and utter sham, (and part of that sham is Gladstones Solicitors itself)”
"The appeals process at Excel/VCS is run by a team of minimum wage office workers with no legal knowledge or experience whatsoever,"
" It is claimed by the head of the appeals service (retired Judge Bryn Holloway) that this is a completely independent fair process, it is not”
"The letter mentions two individuals—Will Hurley and Bryn Holloway—and concludes this is a typical example of the clear collusion between the IPC, their members and the IAS"
"what we can do about roboclaims companies and solicitors firms that profit, often in shady ways"
" the very large amounts of money that can be involved in such scams—a company called Smart Parking was involved in one such scam on my patch"
"tightening up the rules regarding the unfair use of automatic number plate recognition" "BW Legal, regularly issues 10,000 county court judgments a month, and is known to have issued 28,000 in one month"
"They are jamming up our court system, and are often totally unjustified."
" because the lifeblood of trying to extort money from people is having access to their details."

While I slightly agree and understand what you mean, I also think your summary point was correct where by ASDA are probably naive to the situation too. They want to have a monitored car park to stop the real pests but don't realise how much strain it puts on the normal shopper. I think them canceling the fine after realising the distress it caused is a good thing and I'm thankful for that. Hopefully if more people complain then it will cause ASDA to realise how scammy PE is and scrap the contract with them.

Similar to my point above but also want to highlight that ASDA weren't the only company operating in this PE carpark so they aren't fully to blame. I think it's important for more and more people to complain so that supermarket and retailers wake up and realise how much damage it causes. However I also think its important to say thanks (in this case to ASDA) so that more people are able to successfully cancel their tickets with them because to be honest they didn't have to revoke this fine but they did. (Don't bite the hand that feeds you) I understand companies shouldn't be caught up with PE (which is the point you are making) but success stories will cause more people to contact supermarkets etc, and in turn might let them realise how bad PE is and cancel their contact thus helping to shut them down.

Thanks for all of the information, I am tempted to raise this issue with my local MP because again I think the more coverage it gets then the more likely it will be to shut down. I'm annoyed they are allowed to operate like this spreading the scare tactic throughout innocent shoppers, so appreciate the links to take this matter further.
  • I received a £40 PCN from Parking Eye in my local Aldi store recently. The car park only allows 1.5 hours and i went over this time by 37 minutes. This was due mainly to having to abandon my shop to return to my car to breastfeed my son then complete a large shop after. A PCN came through 2 weeks later by which time i had thrown out my receipt. I appealed to PE and of course it was rejected so decided to complain direct to Aldi, i emailed the main customer service and the one direct to management listed on this site. Someone from customer service got back to me and cancelled the ticket!

It spurred me on to take the step of complaining direct to Aldi when PE sent me a letter following the rejection. This stated that out of goodwill they would honour the original cost of the PCN of £40 for a further 14 days rather than increase it to £70! I was not being bullied into paying up and decided to fight it, to which it paid off!

Not surprised that this one was cancelled. So many shops in what was a thriving Black Country town have now closed. BHS has been empty since they closed. Marks and Spencer closed at the beginning of August.

I firmly believe that parking firm infestations are a nail in the coffin of retailers customer base, and they need to wise up much quicker than they do.
