    Hi

    I have just heard back from my own CPP account initially made through Barclaycard and they have upheld the complaint! (From 15th November 2007)

    £624.79 cheque coming this way!!

    Just hope I get the same result for my wife's and son's accounts

  • I recently sent the compensation letter to CPP saying they had missold me their policy, I then recieved a letter saying they had renewed my policy, and had 60days to cancel. I called them saying I wanted to cancel my policy and it was within the time limit and the sales agent said because I was claiming misselling I was unable to cancel my policy as it was now dealt with by someone else? Surely this is wrong and they're not allowed to do that???
  • I have tried to reclaim CPP payments made from 2001. I have used the template letter on the site and had some degree of luck in that the bank is going to refund payments made between 2004 and 2005. They are disputing that they were not subject to agreed industry standards prior to this date. Is this correct and is it therefore not possible to get refunds for earlier policies?

    Yes, this was a separate claim directly to CPP for pre-2005 (I have already sent off the original mis-selling complaint form). It seems very unfair that many people are being refunded immediately if they bought the policy from certain banks/building societies pre 2005, but if you bought the policy direct from CPP they are refusing compensation as they say they were not regulated at that time. Does anyone think I have a chance going to the Financial Ombudsman and how easy is the process?

    As I said in answer to you at post #646 you won't get anywhere complaining to the Ombudsman that the redress scheme does not cover anything prior to 2005.

    Since the regulation of general insurance did not begin until January 2005, FOS has no jurisdiction and cannot adjudicate on complaints from before this date.

    Yes, insurance sold via banks pre-2005 is a different story because they were subject to their own regulation prior to 2005.
  • Apologies if I have missed this elsewhere in the thread, however do CPP confirm that they have received the claim form ahead of any decision on outcome or is it simply a notification of yes/no when they process the claim?

    Hi there, I did not know if they had received my CPP form so I phoned the freephone number on the original letter and the told me that they had indeed received it and informed me on what date the information on my form was scanned into their system. They then said that I would hear from them within 8 weeks. Perhaps you should do this as it gave me peace of mind that the form hadn't been lost in the post! So, to answer your question, I don't think they acknowledge receipt of your claim form separately:)

    Since the regulation of general insurance did not begin until January 2005, FOS has no jurisdiction and cannot adjudicate on complaints from before this date.

    So, are you saying that Moneysavingexpert team is wrongly advising us to complain to the Ombudsman if the bank rejects our complaint?

    If your complaint is rejected by your bank, or by CPP, don't assume that's the end of the matter. You have a right to take any complaint it's turned down to the independent Financial Ombudsman Service."

    No, but you are wrong by implying MSE is talking about pre-2005 complaints which aren't covered by the scheme nor by FOS.
    Only periods post 2005 are covered by the Ombudsman unless your card protection was sold by one of the major banks.
