I have read the above with great interest as I am having a similar problem with CPP. I was sent a cheque by CPP as a result of my claim but it was sent to a Uk address I use for many mail deliveries as i live in Europe. Not having been back to the UK since last June the letter containing the cheque was only picked up by my wife when she returned to the UK two weeks ago.
She attempted to pay it into my bank which she did successfully only for it to be not honoured three days later. The bank have returned the cheque to me and this afternoon I telephoned CPP from Europe requesting them to reissue the cheque which I understand is in accordance with UK law. After spending ages confirming who i was the gentleman from CPP then informed me that he could not reissue the cheque as the High Court judge who ruled on the CPP Compensation Scheme had stated that CPP were not legally bound to reissue a cheque after 6 months.
I stated to this gentleman that UK law was quite clear in that CPP had a legal contract with me and that they were legally obligated to reissue the cheque. I also stated that i doubted that any High Court Judge could make a one off law that circumnavigated existing law. He was unmoved and I was not impressed by these charlatans. My next course of action will be writing to them and asking that the cheque be reissued in accordance with UK law, failure to do so will leave them in breach of a legal contract.
From what i have read above I believe this to be the correct course of action at this stage.
I'm another who has unfortunately just had my refund cheque dishonoured, as mine was issued last September and I only banked it last week.
I just spoke to CPP now, and they said there was no chance they'd reissue it, and referred me to Section 5.10 of the High Court's Scheme Arrangement:
Any cheque not encashed within six months shall be cancelled and the Scheme Claim to which it relates shall be deemed to have expired and such Scheme Creditor shall not receive any Redress and shall have no right of recourse to the Dispute Resolution Procedure. (Can be found here: http://cppredressscheme.co.uk/Scheme_Document.pdf)
Funny how the letter accompanying the cheque didn't mention that it needed to be cashed within six months - I wonder why! I asked CPP if there was any way I could escalate/attempt to resolve this within the organisation, but was told no, and that the Financial Ombudsman would have no jurisdiction either.

Hello,
I am in the same situation, phoned them today and they said there's nothing to be done and the money are basically lost. I had no idea they are not issuing replacement cheques after 6 months! As the poster above said, that's not written anywhere on the letter which accompanied the cheque....
Should I write them instead? Is there any point chasing this further - I mean, do I have any chance of getting a new cheque from them if they are not willing to do it?
It's not a huge amount, but enough for me to feel bad about losing it
Thanks for any advice!0 -
For what it's worth, I have posted previously that any CPP premiums paid prior to 14/01/05 are not covered by the FCA/CPP Ltd. 'Scheme of Arrangement.' These can be reclaimed directly from the lender who charged these premiums to your account. I can confirm that at least one major credit card firm has been doing this, and adding 8% simple interest as well.
Another aspect not covered by the CPP Ltd. 'Scheme' is the fact that the lenders effectively charged apportioned account interest on these premiums (often at a rate of around 29.9% compound interest), which has been completely ignored. This accrued on a monthly basis, and is quite possibly worth much more than the paltry amounts offered by CPP Ltd., anyway.
However, nobody here at MSE seems to have grasped this important aspect - not even Martin Lewis, the Expert himself. In many cases, this overcharged account interest could be worth many more times the value of the premiums being refunded under the CPP Ltd. 'Scheme.'"I [may] disagree with what you say, but I will fight to the death for your right to say it." - Evelyn Beatrice Hall - a friend of Voltaire.0 -
I contacted CPP prior to 2005 to open a card protection plan then later on Alliance and Leicester gave me the protection free so I didn't renew my existing policy at that point. Am I still able to claim compensation for the previous policy?0

Hi Ruxton28. You should be able to reclaim your CPP premiums paid prior to January 2005, as they are not covered by the CPP 'Scheme of Arrangement.' I would suggest that you contact CPP Ltd in the first instance with your claim, and they may refund your premiums plus 8% simple interest. However, they may tell you to reclaim them from the card provider who you actually paid the premiums to.
In any event, CPP are unlikely to refund you the portion of account interest charged on those premiums by the lender, and you would need to reclaim this interest from the lender, anyway. It is still uncertain whether the lender will refund this 'CPP-Associated' account interest, but is worth claiming it. I know of two claims in progress for this interest - one of which is now awaiting FOS adjudication.
I believe that this interest will be refunded eventually because it is fair and reasonable to do so in law, and the courts have generally upheld this principle for most claims over the years involving bank charges and PPI etc. For the FOS to deny it would be very difficult IMHO. My previous posts in this thread might expand on this further for you."I [may] disagree with what you say, but I will fight to the death for your right to say it." - Evelyn Beatrice Hall - a friend of Voltaire.0 -
Just a quick note to say thanks!
I saw this article on an MSE email a couple of weeks ago and thought I'd give it a try... I had a card protection policy with Halifax from 2003 to 2011 but didn't have any details - just a vague recollection! The initial call I made to the claims enquiry phone number was unsuccessful as they advised my policy was outside of the dates they were dealing with (I didn't receive a letter).
So I downloaded the letter template you helpfully provided and sent it to the bank...
Got a call today to be told I'm being sent a cheque for £231.98! What a surprise! Really glad I spent 10 minutes doing that letter and sticking it with a 2nd class stamp now
Thanks again.0 -
I have been sent information regarding compensation on AI scheme with Sentinal. I thought that this was from my current account Alliance and Leicester which became Santander. I called the helpline no on the AI information to be told that this was with lloyds and that I had paid this from 1997 to 2009 .
I have now discovered information regarding CPP policy I have had through my Premier 50 account for which I paid a fee of £12 monthly.
I didn't ever receive any information about compensation regarding this > I now see the date by which a claim has to be made has now passed.
Would I have qualified for any compensation or would I have had to buy the policy seperately. I had previously had cover through Sentinal and part of the reason I was attracted to this account was that cover for my cards etc. Any information re this would be appreciated Many thanks Sue0 -
Have read through several pages of posts on this forum. I am too late as the deadline has passed. I probably would not have had a claim as the policy was part of the perks of current account which I paid a fee of £12 a month . I have no memory of ever having received any information regarding this. I had the account for several years and it was closed as I say when they changed me to their 123 current account. Thanks anyway Sue0

Cheque has been forward to me from an old address so in the same boat as others. Is there any realistic form of redress to get it re-issued or is as per the section set out in thekiwibex's post?
Help gratefully received. Thanks0 -
