thanks for the info.
What I find so frustrating was that I was on incapacity benefit which changed to ESA which in order to get I had to attend interviews and give all the details etc. This apparently is only paid for a set period and I stopped getting this in November.
I took advice and applied for PIP in August last year and was surprised to learn that all of the previous interviews were dis regarded and we had to start again.
So as of today I have been waiting 27 weeks, it would be nice to just be told an approximate time span.
I have asked if the benefit was awarded would it be backdated? One person says yes another no
All very confusing and extremely stressfull
If awarded, back pay would be paid, from the date of the claim.
ESA and DLA/PIP claims are treated as separate, so fresh info is needed for both.

I was travelling a round trip of 170 miles to Glasgow, as I had got the appointment there quicker than Dundee. Was about to leave the house, actually putting on my coat! when the phone went. It was Atos cancelling today's appointment. They said a letter would be sent in a few days with a new appointment, but considering my son had taken a day's leave to go with me in Glasgow, and I had been waiting since September, that wasn't good enough. She had no idea when the next appointment would actually be- so probably another 6 months!!!!0 -
Hi i'm new to forums but had to share my story.
I was working at a law firm and due to start as a trainee solicitor but had to have emergency surgery on my spine following paralysis of my right leg below the knee. last year. I lost my job and moved in with my parents as I was running out of money. Applied for PIP in July 2 days before my 27th birthday and had an Atos assessment in September.
In November my younger sister was diagnosed with a terminal illness and all my family have been focusing their finances on her as we were told it was only a matter of time before she will pass away. she is at home to spend her final moments with the family now.
I have explained this to atos and how I cannot be expected to rely on my parents when the entire family is going through such a tragedy. like they give a damn.
Im still stuck in the auditing limbo with no response from Atos whatsoever.
I have enough on my plate as it is and am totally at the end of me tether with it all. sorry for my rant0 -
You can try contacting your MP, or making a formal complaint to ATOS, but I am not sure either will do much good.
This delay is not uncommon, unhappily.

update just found out that the DWP have my report now , they have had it since yesterday so after a 8 month wait it may be coming to a close please keep fingers crossed for a good outcome , thanks for the support .0

hi,wife a call today from dwp,they said they now have my wifes claim and needed adjudicating,then she explained that on Monday that capita had called and said her claim had been lost,they did not lose it,but sent it to dwp and erased the claim on capita,s system in error,anyway dwp have it now and could take up to 4 weeks to finish claim and inform my wife of her claim decision.at last getting some where .0

Thanks Lin, have tried these options but not holding my breath.
This may just be the lawyer in me speaking but I surely believe that there must be some kind of negligence related damages available for such cases where those waiting have had to borrow money with interest while waiting (I'm thinking the robbers at these payday loans companies willing to give anyone a fast loan regardless of their ability to pay it back)
Also, those who have incurred income related penalties such as late payment of rent or overdraft fees should at the very least be recompensed.
They are leaving us all in a deep rut and no amount of back payment is worth the financial damage we may incur while waiting for a response. I understand fully that it can take time and allowances should be made for reasonable processing times but in some cases its coming up to a year!!!! mine has been nearly 8 months with no end in sight.
All this undue procrastination is ridiculous. when I asked when my file was last worked on she said October, and I bet that was probably just an admin clerk putting my details into their system.
I'm going to look in to it thoroughly and keep everyone updated. They can't get away with this surely.0 -
No decision yet, just called. The chap I spoke to though did sound quite apologetic, saying I should have a decision soon and a letter will be sent but that I am welcome to phone to check again, just make sure I don't run up my phone bill too much!
Also had my letter from my MP arrive today. I think it just coincidentally crossed paths with my report making its way through the auditors as it just says the DWP now have my report and they aim to make a decision within two weeks but it's pretty much been that long now.
At least there's light at the end of the tunnel though.0
