Hi Clairebear,
Make sure you download the form off the gov.uk website else they wont except your appeal and dont forget to put your MR letter with it to.
Best of luck. XXX
Thankyou I sent appeal off today along with an 8 page letter showing how unreliable the medical report was and how things contradicted one another etc........... wish me luck. I really hope the tribunal are more professional than what capita and dwp have been regarding my claim x0 -

You can only do this if the letter doesn't contain any new information. They will only accept information that is related to your assessment. For any new information for E.G any new diagnosis you will have to put in a new claim. x0 -

Actually so upset! Only had my assessment two weeks ago and received my letter today giving me nothing for mobility. I'm genuinely shocked at how someone who has never met you can state how far you can walk. I use 2 crutches and never leave the house without someone with me. I really only leave to go to appointments. Can anyone please offer any advice on what to do? I've called and asked for a reconsideration they told me it may be over month until I receive a callback0

In the meantime, you need to gather evidence regarding your walking problems and if it applies, other help you need outdoors. That is, there's descriptors for people who have difficulties outside but can walk. (ie, for people like me who needs someone with them to ensure they don't get lost, etc)Sealed pot challenge #232. Sorry to hear your application was declined. I am awaiting the outcome of a Mandatory Reconsideration and know its a long drawn out process. Firstly, do not rely on anything they tell you regarding timescales. My advice is do not wait for callback as you only have 28 days to lodge you request for a MR. All you are doing by waiting for callback is extending your wait time. I know they do not have a timescale to adhere to for MR'S but they quote 8-9 weeks at present. Mine was requested by phone on 2nd Aug and I was told 8-9 weeks from then. Now after ringing today they tell me it was added to a case managers case load on 1st then 8th Oct and I am looking at early December!!!
Anyway, onto what is best for you to do now. I, after 4 weeks of frustration waiting for call I decided it was in my best interests to be proactive and get the ball rolling myself. By the way I was awarded higher rate mobility but nothing for the care side. I rely totally on my daughter for care, cooking etc. What I did was look at each discriptor one at a time and the assessors comments and went into detail on each one as to how Iwas affected in truth opposed to what the assessor had written. I have to say the report did not reflect our conversation/assessment which took place. I was careful not to criticise the assessor but let it be known factually it was not correct.
44 days after I requested MR I got the long awaited callback. The case manager was very nice full of apologies for not calling within the required 5 YES 5 days. She said my letter was absolutely perfect and covered every single question she would have asked me. She kept praising my letter so we will see as actions speak louder than words. What she did advise me to do was to get some additional evidence. Obviously they had not contacted my GP or any of my 3 consultants. Anyway I asked my GP for a letter which he kindly did for me. He clarified I genuinely suffered from Widespread Arthritis, Fybromyalgia, memory loss, severe exhaustion, long term depression and diviticulitis. He stated I find it increasingly more difficult to carryout daily tasks or care for myself and that I can not stand for more than couple of minutes due to pain in my feet, toes and knees. I am lucky in the fact my daughter is a skin care hygienist and trained beautician but I hate having to rely on her. She has a 3 year old with autism and literally never stops. She is a wonderful mum and daughter but it hurts me so much I should be helping her not the other way around. The daily care component would enable me to afford some outside help and make such a difference. After working for 45 years full time I feel uncomfortable claiming benefits. Goodness knows why?
Anyway, I hope my rambling post helps you in your next step in fighting for some help and understanding in what is a really stressful process, I will post an update as I receive one but I won't hold my breath for a favourable outcome.
Just a quick observation - I have read hundreds of posts regarding the care side and from what I see 99.99% are awarded 7 points? Call me cynical but.............0 -
Oh my gosh i cannot believe it I phoned today to make sure they have received a letter sent from my caseworker for my mandatory reconsideration which they had and was then told a decision was made yesterday and I have now been awarded enhanced daily living and it's all being backdated from November I have been advised back pay will be in account next week just waiting for letter now0

@Nana55 thank you very much for that message I truly appreciate your reply. I genuinely believe that they don't listen to most of us! Did you call and ask for the assessors report? Thanks again!0
