    Ryanair have emailed us regarding flights in September we booked in January telling us we cannot have our booking anymore and instead saying refund or flights on different days. The flights have not been cancelled because we know a number of people who are on the flights there and back who have not list their place. Seems to us they have overbooked and bumped us off with 2 months to spare. Because alternative offered are on different days we cannot now go due to work and will miss the wedding.
    Does anyone know if they can do this without compensation?

  • 8 hour delay on thomascook airlines 2010. entered into correspondence with them but no booking confirmation or no boarding pass fruitless.
    bit the bullet and went to flightdelays.com(a front for a no win no fee solicitors)
    29%commision + £25 + vat

    result me and wife just got £108 each.

    if thomas cook played ball they would have saved.

    i know martin might not agree but this is better than rolling over and dying,good luck to the people who did this on my behalf.

    lesson learnt if you've been delayed etc keep proof of travel arrangements

    AESA do not have the power to insist that an Airline pays up - they only give a judgement. You need to a Law firm who will unfortunately charge you (countries in Europe - like Spain cannot reclaim legal fees under 2000 euro) It may take 18 months (see my previous postings) and may well financially not be worth it.

    This was a flight to UK airport, and I am pretty sure you can sue in UK which is nearly free via MCOL or use a nwnf . I'm sure you have already read Vauban's guide....

    AESA are the European Airline Governing body with whom I have had dealings over the last year. If the case can be heard in the UK then that's another matter but elsewhere in Europe it is very much a different story.

    Recently got this email back, Was hoping to see more as i was delayed by approx 12 hours flying from Bangkok to Oslo, Norway. The reason being the Pilot was sick and another had to fly in , and then get his rest time. Any advice?

    Thank you for contacting Norwegian. We regret the time it has taken to respond to your claim and we thank you for your patience in this matter.
    We sincerely apologise for the inconvenience caused by the delay to your flight, DY7202 from Bangkok to Oslo on the 4th of June 2015. Regrettably, this flight was delayed by 11 hours and 46 minutes due to unforeseen illness amongst the crew.
    We understand that punctuality is vital for our passengers, and Norwegian strives to ensure that all flights operate according to schedule. Regrettably, due to the nature of air travel, delays and cancellations are unavoidable and do occur from time to time.
    In accordance with the legislations which we are bound by, we are not liable to provide compensation if the disruption was caused by reasons deemed to be outside of our control. Circumstances that are beyond the control of the operating air carrier are events that are not caused by an act or omission of the air carrier. In light of this information, unfortunately we are unable to honour your request for EU compensation.
    Norwegian would however like to provide compensation with the amount 150 USD as a gesture of goodwill due to the inconvenience and long waiting time.
    We respect that our response may not offer the outcome you were seeking, however we must adhere to certain guidelines to ensure we are providing a fair and equitable service.
    For the avoidance of doubt, we refer to the relevant verdict found in the European Court of Justice which applies to your particular case.

    European Court of Justice – C-402/07 (Sturgeon):
    The EC Regulation 261/2004 does not expressly provide compensation for cases where the flight has been delayed as it does in the case of cancellations. According to the decision of the European Court of Justice in case C-402/07 (Sturgeon), the passengers affected by a delay should be compensated under the terms laid down in Article 7 of regulation 261/2004, when they reach the final destination three hours or more after the original scheduled arrival time. The airlines are exempt from further compensation if the reason for the delay is extraordinary circumstances outside the airline's control.
    We trust that we have clarified the reason for our decision and hope to welcome you onboard a Norwegian flight again in the future.

    Montreal Convention is related to lost baggage compensation rules. I cannot see any link to EU261.....are you connected to that site somehow?
