    The difficulty you may have is if enter air have no UK office/prescence/assets if it comes to legal action/enforcement.
    There could be an arguement that Monarch are liable. it depends on the nature of the agreement. Given that you book through Monarch and are not told at any stage other than arrival at airport (my daughter has just flown Manchester/Zante), you couold assume its a Monarch flight.

    Sorry to say that Monarch are washing their hands of any problems (delays included) on their wet leased flights. They are currently regularly using JetTime, Small Planet and EnterAir and they will point you in the direction of their t&c's regarding substitute carriers.


    Delay claims have to be submitted to carrier concerned which may be easier with JetTime (Danish) however EnterAir and Small Planet is a different proposition.

    I think Mr Clarke makes it quite clear on the video that the company you booked your flight with ie Monarch are liable not the actual carrier who you flew with. Am I reading it right?

    That is certainly what Mr Clarke is saying but I am not sure that is correct. It is the actual carrier who is liable, I think he may be talking of code shares which is not relevant in the Monarch situation.

    If you checked in with a ticket which had a flight number ZB124 but on boarding you discover it is something else, Monarch appear to be the carrier but if your tickets clearly show Enter or worse, Exit Air, I fear the claim is only against the actual intended carrier. There is a thread about Small Planet, it could be a long haul to get compensation......
  • Hi, Came across this a few weeks ago and by coincidence we had a flight boooked easyjet a few days later...On the way back from alicante the flight was delayed 6 hours and 32 minutes...With this thread in mind i wasnt to bothered, in fact i was hoping it would be delayed a wee bit longer!!:T The whole time we were delayed they (easyjet) told all of us the pilot in Belfast was ill and the replacement was on his way..When we eventually boarded, the pilot announced that the pilot was ill and he was the replacement..accept our apologies and all that. I downloaded letter asking for compensation and got a reply..'sorry for the delay, the flight was delayed because of bad weather and you are not entitled to compensation' hmmm:mad: sort of threw me a bit..wasnt expecting that..now what do i do..please help.

    Make big pot of coffee. Read Vauban's guide and as many other posts as you can manage. Then, probably, send airline NBA (Notice Before Action) letter, and prepare to take them to Court yourself or through a nwnf lawyer.
  • Not in the slightest bit worried about talking them to court myself...Ive plenty of time...If they hadnt of tried to palm me off so much and werent so patronising, maybe I wouldnt be so bothered with the hassle...
