    So do I press them further? They quoted that case in their response and said

    "A recent Supreme Court decision in the case of Huzar vs. Jet2.com, has resulted in a change to how EC Regulation 261/2004 is interpreted. This is the Regulation that provides for compensation payments for flight delays so we wanted to check if the outcome from your previous claim has changed as a result of this.

    Following the review, under EC Regulation 261/2004 your case has been re-assessed and I can see from the aviation report that your delay was caused by a bird strike to the aircraft intended to operate your flight. Based on this information under EC Regulation 261/2004, delays due to bird strikes were not affected by the court ruling and remain classified as extraordinary circumstances, therefore I am unable to offer you compensation for your claim."

    I don't want to involve NWNF if I can avoid it - any suggestions?

    Well if your delay was less than two years ago and birdstrike is the only reason for the delay then they don't have a case that they can argue successfully in court because you can pull out a District Judge ruling that says otherwise.

    I would write a notice before action quoting this recent judgment and say that if you don't get compensation in 14 days you are going to take them to court. If they don't pay up take them to court.

    Isn't it funny that after they are shown up on national radio Thomas Cook are suddenly very apologetic and take steps to fast-track the payment today. I wish we could all go on you and yours.

    Their customer services agent "incorrectly attributed" damage to the aircraft doors from the steps as a manufacturing defect.

    My letter has just gone out & online form & email to Stelios!


    Flight was meant to arrive at Paris Charles De Gaulle @ 18:30pm but didn't get there until 11pm, following an obviously long delay.


    What makes it worse is my return flight was the very next day at 12:40 in the afternoon. Gives a new meaning to whistle stop stay!


    Meanwhile, we missed the dinner we flew out for, ruined the special event and came home exhausted. I am so irritated I cannot put it into words.


    easyJet my a**.

    Hello just thought I'd drop a line to say unfortunately I was unsuccessful. I fully expected to be to be honest - our flight was delayed due to a bird strike - it hit the engine as the plane came into land at Mahon Airport, Minorca. The Spanish engineers checked it and said it was okay, but the pilot wasn't happy and they called British engineers to come over from London to check. We finally left Mahon 8 hours later than the scheduled time - but I guess it was for safety reasons. Wouldn't have been happy if there had been problems mid-flight because they didn't check it properly. I just thought I'd ask and see if they would give compensation - but they said No



    I wouldn't be 'fobbed off' so easily. Belligerence pays. Pester them and don't give up!

    Flight - Gatwick to Dalaman
    5 hour delay due to oil leak
    Received £7 per person vouchers for food and drink at the time

    On our return, a week later, we applied for compensation through the Thomas Cook link on the main MSE Flight Delay page and included a scan of the flight delay apology letter which we were handed at Gatwick with our food vouchers.

    Today we received a voucher to use on any Thomas Cook holiday for £1180 - equivalent to €400 per person.

    Whooppeee!!!!! We're going back in October now for another week!!!!

    Thank you MSE and the fellow passenger who gave us the heads up to look into flight delay compensation x
