  • Could someone help me. I was delayed 17hrs with a Thomson flight. I have just received an email saying I can't claim as the flight delay wasn't within 28 days.
    The flight was 07/08/2012. I read that you can claim up to 5 years. What can I do ??:mad::mad::mad::mad:

    did you specifically say you were claiming under EU261/2004...maybe have a read of Vauban's guide https://forums.moneysavingexpert.com/discussion/5173888

    I've been through the process following the helpful guide on this forum up to the point of threatening legal action. I then contacted Botts & Co and they have said that as my wife chose not to fly then we have no claim for compensation.
    Hope this helps anyone in a similar situation.

    Looking at what you have posted previously I would disagree with Bott & Co on this occasion, you have to look at follow on cases such as Sturgeon and Wallentin to see how the regs developed and I still believe you have a valid claim along with JP.

    AFTER 5 HOURS YOU ARE ENTITLED TO COMPENSATION REGARDLESS OF WETHER YOU FLY OR NOT!

    read the links in Vaubans guide and make up your own mind

  • Can anyone help my soons flight with AA from Manchester to Chicago was canceled and not rearranged for 48 hours. I am claiming compensation from AA but cannot find a UK address or email link in UK. I have contacted customer relations but only get an acknowledgement. Help please !

    have a read of Vauban's guide too, if the cause of the cancellation was weather or ATC then compensation does not apply

  • Hi all,

    I'm new to the forum and would like some advice. I'm currently waiting for my delayed flight from Madrid to Birmingham (BHX) which was due to leave at 9am and arrive at 1020 (GMT). It is now due to leave at 1245 (so the delay is over 3 hours now).

    However at around 0855 whilst the plane was fully boarded, we were told that due to a bird strike from the previous flight from London we would need to disembark and wait for a technical review. They added that they never spotted it in the first check.

    Under normal circumstances I am going to assume that bird strikes won't allow me to claim, but my question is that since they didn't spot it in the first review does that change the situation and allow a valid claim?

    note that it is the arrival time that is important (not departure)
    Birmingham Airport is showing a 13:20 estimated arrival...I would expect that they do all they can to get you back in under a 3 hour delay

    Remeber arrival time is the point at which the doors open and you can exit plane, so make a note of it.
