    I've just had a case put on hold with reference to the C. Van der Lans//KLM case regarding technical faults and unforeseen circumstances.

    Have any of you had experience challenging this response and have any wisdom to offer?

  • Hi Thomas Cook have just agreed compensation at €400 per person (£290) for my family 2 adults and 2 children, they have said as we got 1 free child (actually £1Place) we are unable to claim for 4 people, they will only pay out for 3 people is this correct? I'm not complaining but just want to confirm they are acting correctly. Thank you in advance

    If you paid £1 for a child place, then by definition, it was not free.

    According to the regulations you are due 4x compensation payments.

    Also, they are under scrutiny by the CAA at the moment with regard to paying customers under EC261, so they probably don't want it plastered all over Twitter that they are still rolling out the same old excuses and not paying out when they should.

    If the infant was sat on your lap you also need to be wary of them using an invalid defense saying that it is a fare per seat. There have been instances where airlines deny claims based on the fact that the infant did not have a seat, where in actual fact, £1 = fare = claim, no matter whether they had a seat on the plane or not.

    Keep fighting and you will get the pay out eventually

    Background information is that my original bookingin 2011 scheduled flights with Iberia from Malaga to Madrid then Madrid to Miami then Miami toProvidenciales (Turks and Caicos Islands). I received an Email confirmationfollowing my payment of approximately one thousand pounds sterling. Sometimelater I received an Email notification changing the flight time of the firstflight from Malaga to Madrid. I confirmed this was not a problem for me howeverwhen I arrived at Madrid to check in for the flight to Miami I was informedthat my subsequent flights to Miami and Providenciales had been cancelled andremoved from my booking. This was "an oversight" by Iberia.


    Iberia accepted this was their fault and they arranged overnightaccommodation for me in a Madrid Hotel. This was very inconvenient for me as Ihad appointments in the Caribbean. I was delayed over twenty four hours most ofthe time being spent at the Iberia check-in desk in Madrid. Nothing else was offered to me. After I heard of the EU Legislation I contaced Iberia in Madrid in February 2014 to register my claim. They said they would give me some Avivos points.. I said I didn't want them - they didn't reply and I didn't get the points anyway. I took my comlaint to AESA the governing body in Europe - they upeld my clam (600 Euros) and they advised Iberia of this. Iberia stil not paid so I contacted a Barcelona Lawyer who took up my case (at my cost....) and he received a letter from Ibeia saying they would settle my claim but today still nothing - my own legal costs are a reasonable Euro 250 however in Spain I cannot claim any more than Euro 600... how cazy is this....
