    Yes I think I'm right in saying both your claims are against Thomas Cook?

    Jet2 got pulled in because your case was stayed, pending the Jet2 SC appeal.

    1 st claim..... Unless you commenced legal action within six years, 111KAB is of course correct, you stand very little if no chance at all at claiming.

    2nd Claim as 111KAB says, sounds valid and you need to issue an NBA start by reading Vaubans guide

  • I'm writing to share my success with a claim to Thomson for a 6-hour delayed flight for myself and my husband. The delay was a result of the technical failure within the engine.


    I contacted Thomson in September 2014 using the edited template from the site and referring to the corresponding regulation. I provided the necessary flight details and stated the claim amount of 400 euros each (based on the travel distance and the delay). There was no response from the company in 8 weeks, after which I wrote to them again.


    A week after that, still with no response from Thomson, I contacted the CAA by filling in their online form. I attached my (one-sided) correspondence with Thomson, a copy of my boarding pass and the receipt for tickets stating both passenger names.


    I was surprised to receive a quick response from the CAA (within a week ) telling me they are in contact with Thomson about my case.


    The next thing I know - couple of weeks later - is a letter in my post with a check from Thomson for the equivalent of the 800 euros - the full requested compensation for the two of us.


    Overall, I think the procedure was very easy to follow using the guide from the MoneySavingExpert site. It was solved for me in 3 emails and a bit of research. The results of the two recent legal cases where the airlines were denied to attribute technical faults to exceptional circumstances was very timely for my claim.


    I feel that stating the regulation based on which the claim was made was very important for the overall success, and of course evaluating whether my particular case satisfied all the requirements (EU flight origin, company fault, etc).


    Shame on Thomson for not responding to customers, but well done CAA for sorting it out! Thanks to Martin and his team for their guide, and good luck to everyone with enough perseverance!

    No - I don't believe for one minute that the CAA were responsible for this, particularly if there was only a couple of weeks between the CAA letter and the cheque arriving.

    As you'll have noted from the Thomson thread, the airline seemed to have a massive change of heart about three weeks ago and started writing out to people to whom it has previously rejected - indeed many people hadn't been in touch with Thomson for months. I suspect the OP was one of these.
  • I originally submitted a claim to Monarch in 2010, following our flight from Manchester to Faro being delayed by approximately 14hrs, due to a technical fault. Their initial response was to offer a £50 voucher per passenger (3 passengers) to be used against a future flight. Needless to say, we rejected this outright. I then appealed to the CAA, and eventually got the following response from Monarch:
    "
    As you are aware following your correspondence to the Civil Aviation Authority (CAA), they have asked us to review your flight delay claim again.

    We have now fully re-investigated your claim as requested and can advise you that we are satisfied that the reason for your delay does fall within the extraordinary circumstances criteria and therefore compensation is not payable and your claim has been concluded.

    As part of this process it was a CAA requirement that we provided them with detailed information surrounding your flight delay and I can confirm that the CAA have now received our findings and conclusions.

    We are unable to provide you with any documentation regarding this delay as this will only be disclosed to our regulator.

    Please note that the individual circumstances surrounding your delay or any service issues you may have encountered do not form part of the criteria when assessing flight delays for compensation in line with EC261/2004."

    However, once I had heard that the recent appeal cases had been found in favour of the claimant, I re-submitted my claim to Monarch (November 2014 and December 2014). To date I have not received any further response other than their automated response.
    What more can I do?

  • Thanks to Martin and his expert advice I recently was awarded $500 each for my party of 4 total $2000 for future flights to USA from United airlines. Which ,we have redeemed against 4 flights to USA in May meaning a total saving for each member in our party of £320.

  • Has anyone managed to get anything out of Monarch without resorting to legal threats and third party companies? I have a genuine claim which I presented to them in July 2014 but apart from a few automated responses acknowledging receipt of my forms I've received nothing from them.
