  • Hi, 1st timer here, please be gentle!

    It seem I have a case for compensation after all the reading above posts, but want to check. I'll be brief with my query!

    I paid for 2 flights for my sisters in law to fly from Marseilles to Stanstead with Ryanair
    The delay was due to a "technical fault" (flights were leaving to / from Stanstead - no weather issues for this flight)
    The flight time was sched at 07:00
    The actual departure time was 17:45
    They were given a 5 euro voucher for food at the airport.

    Are they / me (as the bill payer) entitled to the 250 (or part) euro compensation per ticket as per Article 6 of REGULATION (EC) No 261/2004?

    re the 261/2004, what exactly is that and how do we explain in the letter what it is and what parts of it we are claiming they have not adhered to?? sorry for all the questions, really appreciate your help.:beer:
  • Hello we had flights booked from faro to gatwick from 22-27 december but what with the snow and cancelled flights and closed airports and then threatened strike at faro airport we changed our flights to 3 jan - ryanair webpage said no charge for changed flights due to cancellations etc but then when i finished making the changes they charged 129 pounds - do i have any redress as our flight was not actually cancelled but we did not want to wait until it was or hang about at airports for hours - we thought we were being helpful and got quite a shock to have to pay over half again.
  • Hi All, we have just had to return home from a cancelled flight which forms part of a package holiday.

    The flight delay is 24 hours, so we loose a day of our holiday as well as the inconvenience of going back home.

    The reason for the delay was technical Problems as the Plane destined for use by us was diverted to another airport.

    My question is what can be claimed, firstly the flight looked like i can claim 600euros per head as its more than 5 hour on long haul...

    But what can be claimed for the loss of the days package holiday, which was all inclusive with meals and drinks.

    There was a Thomas Cook flight operational at the same time which has gone, as people were saying to book a seat on that but it would have cost us over 600 pound once you factor in the extra baggage allowance and food included with thomsons as well as organising transfers at the other end.

    Can anyone give advice or confirm any of the above comments.

    Should i write to Thomsons claiming both the flight compensation (under EC 261/2004) as well as the actual holiday side, and if so how do I pursue the holiday side compensation, does anyone have or know of any draft letters etc. Do i ask for an amount, or just ask what they are willing to do ?

    Has anyone been successful in such case, which seems to me quite clear cut as there is no extra ordinary conditions, such as weather, volcanoes etc.

    Sadly it would be viewed that the amendments were at your request and therefore the fees are indeed payable.

    Your original flight, at the time you changed your travel plans, had not been cancelled. Had it been so then the fees would likely be waived.

    - as I understand it the compensation is for a cancelled flight or in a case that you have been bumped - not a delay. If you think about it, how many airlines are going to be able to afford to pay 600euros per person against what you paid for the flight and still stay in business.

    You would have been entitled to a "duty of care" for the delay, meals, hotel accommodation is overnight, a couple of short telephone calls. Did you get these?
    But what can be claimed for the loss of the days package holiday, which was all inclusive with meals and drinks.

    - you may, or may not get a small payment from the tour operator against this. You will need to write to them and claim. Likely I think to be £10-£20 per person if anything.

    - see note above. You won't get 600euros per person. A polite letter might gain you a small exgrata payment. Don't look to get rich from it!

    Disappointing start to your holiday I know (been there as well) - but sometimes just one of those things. Hope it didn't spoil your holiday once you got there.
  • Cancelled Flights from outside the EU.

    I recently returned from Nairobi, 5 days later than originally expected to Heathrow Airport due to the closure because of teh snow.
    My question is, what compensation can I get regarding this disruption as the Airline are being very negative about me claiming accomodation (they say they do not have to provide it) and the delay was due to snow and beyond their 'control'.
    They eventually got me home after 'wait listing' me on the next four 'failed' flights out. I am being told al sorts of stories by various people and organisations that tell me that the Airline should provide accomodation. All I can see reading through different articles that it all depends on if the Airline is based in Europe...... I am slightly confused!
    Any tips and advice on how I can claim back compensation would be appreciated. I do feel the Airline is being very unreasonable at this stage.

    Compensation is not payable in extraordinary circumstances, eg those the airline could have done something about, if the flight originates in an EU country or is on an EU carrier. Therefore it is not payable due to bad weather.

    However you are entitled to "care" such as meals and accommodation.

    Did you have travel insurance as this would pay out for delays, normally over 12 hours.

    The 'care' entitlement, is that something the Airline should be providing? If so, I have been told by them that they are not assisting with accommodation, but I am compiling an e-mail to the Customer Relations Dept as we speak seeing if they are going to assist with payments...etc.

    I have travel insurance and they say that I am only entitled to 'inconvenienced' payments ie £20 for the first 12 hours and then £10 for any subsequent 12 hour periods of delay. No accomodation unfortunately
