I had a delayed flight from Prague to Manchester back in 2010. It was with BMIBaby who no longer exist and BMI has been taken over by BA - is there anyway I can claim and who from?

Yes you can claim off BA.
  • Cheers for that.
  • I flew back from Sydney to Heathrow in Mch 2013 with Malaysian Airlines. I was delayed for 9 hours at KP. They did put us up in nice hotel with food etc. my query is : do Malaysian Airlines count as an airline that will pay out under this compensation scheme? My original flight was from Heathrow to KP on route to Sydney which was fine, it was the return that was delayed
  • Good morning,

I just wanted to ask your opinion.
We were delayed by around 9 hours travelling from Southend to Barcelona in December - the issue was with Air traffic control, and it sounds like someone forgot to switch the mode from night to day.

I'm not sure if this counts as something that we can claim for, as it wasn't the airport but also wasn't one of the other air traffic control scenarios mentioned.

    Any advice?
    Kind regards,

    Hi All,
I've just contacted BA to follow up on our compensation claim (flight delayed due to technical issues) and the guy said that Jet appealed against the decision of the European Court and therefore compensation payouts in accordance with technical delays are being put on hold until the new verdict is received.
The guy at BA said that the EU Court made this specific request to all airlines affected....BA is drafting a mass email at the moment with the intention of informing all claimants about this 'newest' updated.
Well, not what I hoped for but it's an update at least.

Clynda60, sorry your delay was on a non EU airline flying back to the UK so EU261 does not apply

Spelro, if it really was ATC problems which had nothing to do with easyjet, there is no claim either

Thanks so much for this, does anyone know if the same is true for the Thomson case for claims over 2 years old?

Thomson have submitted their request for an Appeal hearing to the Supreme Court. The SC decision on whether there will be a hearing is not expected until later this year (October/November) - in the meantime I presume Thomson will be rejecting all claims where the delay was over 2 years ago in the hope the SC allow the appeal to proceed and even if they don't their request has obviously delayed claims for another few months.
  • My family of 4 flew recently to fort Myers, Florida. It was an indirect flight connecting in Dallas. Booked through BA but the operator was American Airlines.

We took off pretty much on time. And advised of a flying time of 9 hours to Dallas, as expected. After 7 hours on first flight we were told that due to strong winds, we now needed to divert via Chicago to refuel (seems unlikely).
We rushed to clear immigration at Chicago and then once back on a plane (a different one), just as we were about to taxi to runway we were told there was a problem with tyre. Anyway, this all took hours, we finally landed in Dallas 5.5 hours late and missed our connecting flight to Fort Myers.

Thats not the worst part. AA said due to a convention, the hotels were full. They gave us a printed list of hotels. No offer of phone call. We had to ask for a food voucher. We ended up sleeping on cots on airport floor, As by now it was midnight and they told us to be back by 7.30am, and we had two kids in tow. No blankets provided. It was awful, we didn't have our bags so no change of clothes or basic toiletries.

Finally arrived 16 hours late, didn't make use of our hotel booking In Fort Myers, it wasn't a good start.

What compensation should I claim for?
    Thanks for reading!

This is really useful information, thanks.
