    Yes post on the appropriate thread - do not involve the CAA - take them to court.

    Just a quick query. Having had yet another refusal from Thomas Cook we are thinking about going to small claims. The booking we had with Thomas Cook was for four adults and an infant (infant was didn't have a seat as travelling on lap). Will the claim just be for the paying adults or does it include the infant?

    Best advise is to read FAQ's particularly if going small claims route yourself as this is one of the more basic aspects however if anything was paid for the infant to the airline (there is normally a nominal sit on lap charge) you can claim for him/her.

    Hello,

    We had a delayed flight returning from Gibraltar on EasyJet.
    The plane was unable to land in Gibraltar due to some poor weather and was diverted to Malaga - a relatively common problem. Before you say "no claims can be made for weather-related problems" please read on.....

    While our plane was going to Malaga, identical planes from BA and Monarch landed and took off successfully.

    Before our plane had landed in Malaga, the weather had returned to normal in Gibraltar and there were bright blue skies and the sun was shining.

    On EasyJet's flight tracker service, it stated that a flight from Malaga to Gibraltar had been scheduled and they were bringing our plane to us, which seemed to make sense and would minimise the delay to passengers. But instead, some time later, they organised buses and sent all of the passengers off to Malaga, which included forcing the passengers to carry/drag their baggage across the border into Spain unaided and at great inconvenience to all.

    The final result was that we arrived back to Gatwick over six hours late, but had the airline taken the decision not to inconvenience the passengers, the delay would have been closer to an hour or two at most.

    So, although the initial delay was weather-related and is not covered for a compensation claim, does anyone else agree with me that the airline's subsequent actions leading to the delay becoming at least three times longer than necessary, could have been avoided and so therefore the airline should be liable to pay compensation for making the delay longer than necessary?

    Am I being unrealistic to expect a plane diverted to an airport 30 minutes away (by air) should be brought to the passengers resulting in a 1-2 hour delay? Or is the airline correct in busing the passengers off on a hellish journey that resulted in a delay of over six hours?

    I documented our day and sent a letter to the airline together with pictures but was told where to go!!!

    Any thoughts/help would be greatly appreciated!

    The airline was correct. It cost less to re position the passengers than the plane and the airport may not have had landing slots available.

    It is a very frequent problem at GIB, the airlines know this and should take reasonable measures to avoid problems that result in delays of 3 hours or more.

    Hi Duchy,

    Many thanks - I am fully aware that they were motivated by costs, but just wondering where I stand compensation-wise.
    As Gib has so few planes arriving, landing slots should have been available.

    Hi Richard,

    Many thanks - As a frequent visitor to Gib, it is very frustrating - this was the first time I had to depart from Malaga although I have landed there several times, which is less of an issue.

    I cannot believe that the airlines are not forced to bring the aircraft to Gib from Malaga, especially with the current border-crossing problems.
    My wife and I travelled with my parents (age 76& 79) and we all had to drag our cases across the border unassisted in 28 degree heat/sun, all because the airline could get away with it!!!

    Just a query really, we were delayed by 4hrs from Lanzarote to Gatwick airport. This was due to a part missing on the plane & we had to wait for a new plane from the UK to arrive before we could depart. I'm fine with that didn't want to get on an unsafe plane. I submitted a claim through Thomas Cook & was successful & received £1,695 Thomas Cook cheque for another holiday. I'm pleased with this but if I wanted funds to my account rather than a holiday voucher can we request this does anyone know?
