Jo: they will try to wriggle out of it! Though I think your case is sound.
With apologies to Jimbowen, think very carefully before you involve the CAA. The most likely outcome is that they will sit on your claim for a number of months before sending it on to the airline for them to assess against what are very biased guidelines. And if you are unlucky, the CAA may even agree with the airline and say you have no case - which will make success in a legal action much more difficult. There are very very few people who have had a positive response from the CAA.
So assuming your claim is rejected by the airline, your real options are only: 1) take them to court; 2) engage a NWNF lawyer; or 3) walk away. As Caz says, the FAQs on page one of the Thomson thread is where to start.
From my experience the first question a solicitor will ask is if you have contacted the CAA. It seems to be a necessary evil. The CAA's decision however does not have to be followed by the airline or the courts but can be an influence. In my case the CAA went against us but that has strengthened both mine and my solicitors resolve to see it through.0 -

A shopping voucher would be good! I will call my insurance, write to BA and do you have a best address so that I can write to a Gatwick? I travel a lot so would certainly use credit if given.

Hi
I booked a flight to funchal on the 16/10/13 to depart at 14:45
There was a electric problem on south terminal so they sent us to check in on north terminal
They sent me and family and other 9 passengers with special needs to gate 45g
At 17:30 we and those nine passengers , were told we missed the plane and our bags were waiting for us
They have us hotel and dinner and rebooked us for a morning flight next day
The original flight never left until after 21:00
I've claim to easyjet with no response until now
What should I do?0 -
If you were told you missed the plane and in fact had not (if I understand you correctly) then you were denied boarding. As there is no "extraordinary circumstance" defence to this, you should have a good case. Read the FAQs on page one of the easyJet thread, including the link "What to do next", and the thread "Taking the Airlines to Court".0

Shows just how few passengers are aware of, or acting to protect, their rights under 261/04. Not helped, of course, by the failure of leadership from the CAA.0 -
Our flight from sharm el sheikh back to Newcastle was delayed 23 hours because something was wrong with the plane and had to wait for it to be fixed. They made us sit in the airport all day and we were not aloud out the door, then we were told we were going to be put up in a hotel for the night Our bags got dragged about that much all our presents for our family were smashed to bits not to mention the Thomas c staff all hiding from everyone. But that was june2013 and not in the EU, Anyways I just thought I may be able to claim some money back but reading the MSE article I'm not sure now!

I am now at the stage whereby nothing is being done by the CAA regarding my flight delay compensation claim from 2008. The expiry date for my claim is Sept 2014 so I now need to act quickly. I would like to know whether it will be costly for me to take Thomson Airline to court? have any others already done this and how did they get on? thanks0

Have a read of the first few pages of "Taking the airlines the Court" thread, and the "Court Success Thread". It's not that costly (and you get it all back if you win), but it does require quite a bit of work.0
