Compensation for delayed flights Discussion Area

Hi
I have received a reply from the CAA Re: Qatar airways
Flight delay in Manchester meant arrived 3 hours 17 minutes late and missed connection to Cebu.
Can anyone tell me does this reply leave me no option and does it mean that effectively CAA think I have a case but as they are lightweight then Qatar can stick two fingers up, in a manner of speaking?
I just wonder as you have knowledge of these matters if you think I can and should take Qatar Airways to small claims (my only choice) CAA told me over the phone they have effectively said that Qatar Air are not budging and that the CAA disagree with Qatar's interpretation of the law.
Point of fact the delay happened in Manchester... This flight arrived 3 hours 17 minutes late at Doha airport which resulted in a missed connection.
The scheduled flight length was 5410 km therefore I am seeking €300 per delayed passenger in the respective party. The total compensation sought is €600.
See CAA's final email to me 5/12/2013
RE: Qatar Airways
Thank you for your patience with us while we investigated your complaint about the delay of flight QR046 on 12 July 2010.
From the information given it appears that you missed a connecting flight due to disruption to your first flight. In our view, missed connections outside the European Union on a non-EU airline are within the scope of EC261/2004 (the European Union law on delayed and cancelled flights) and could give rise to compensation, depending on the circumstances which led to the disruption. Qatar Airways takes a different view that missed connections outside of the European Union on a non-EU airline are not covered by EC261/2004.
Due to the difference of opinion between the airline and us on the interpretation of the law, we are unable to take your case any further on the compensation part of your claim. We will now close your file.
I understand that this may be disappointing for you. You do still have the option of going to court. If you wish to pursue this further, you can find information on how to take court action at https://www.gov.uk/make-court-claim-for-money/overview.
We are unable to enter into further correspondence on this issue, but if you have further comments on your case, you may wish to look at our code of practice for complaint handling, available at:
https://www.caa.co.uk/default.aspx?catid=2211&pageid=14097
Yours sincerely
The argument from Qatar is that the missed connection happened in Doha therefore the law does not govern there.
Please if you have any advice, I would be most grateful anything at all would be welcome.
Kindest Regards,

Hi gmar96,
Please see post No.391 in the COURT SUCCESS thread. I had a very similar case against Qatar (same flight number but different date) and it has just been successfully resolved. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
Thank you Tyzap,
I have, by pure coincidence, just been in touch with Botts. As I type I am awaiting a response because the automated flight search cannot find the missed connection flight number.
I personally wanted to go down the route of small claims myself but in your opinion is it better to pay out to resolve this? How much is their percentage take if successful?
Also in response to Centipede100 I did get a response from Qatar some time ago... maybe 2 years ago come to think of it, refuting the 600 euros sum and stipulating that it was 300 euros as delay in Manchester was 3 hours and 17 minutes. Then of course they went on to say that that doesn't matter anyway cos we owe you nought, 'extraordinary circs'
I wonder were they unaware or simply liars?

Well it's the route I chose to go down but you need to read the thread 'ANYONE USED EU CLAIM/BOTT & Co' and then come to a decision.
Good luck. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
We were on a cancelled flight from dalaman on 28/09/2013. I wrote to jet2 and got the usual rejection letter. I reopened this with CAA on 28/10/2013 sending all the documentation through.
Since i have not heard anything and wondered if this is normal? I have sent an email since checking on the progress but just receive an automated response to say they will be in touch.
Thanks in advance

Wrong thread - you should post on Jet2 thread after you have read FAQ's on page one first.0 -
Hi,
Thanks to Centipede 100 and Tyzap,
I have decided to pursue this matter through the small claims track myself.:j

Hi I did post in the USA thread but didn't get a response.
I have just had an offer from KLM for a denied boarding back in October.
I have a choice of 300 euros cash x 2 or 500 euros electronic voucher x 2, as I may fly KLM later next year I am tempted to take the voucher, I have asked if there are any catches and apart from booking on their website there doesn't seem to be.
I am just a little wary, is there anything I should know?0 -
I was delayed in May from Tunisia to East Midlands. It was a flight due to depart around midnight. We were told 2 hours after the original departure time that it would not be leaving etc. It was another couple of hours before we were actually leaving the airport, boarding coaches and heading for numerous hotels. Getting to the hotels at daybreak for a couple of hours sleep. We eventually left around 1pm for the airport again and flew back to UK at new time of about 3.30pm the next day. I read MMS tips on claiming but pushed it to one side. I put a claim in as per the template letter in October and a couple of weeks ago i was as shocked as anyone when Thomas Cook emailed me with my requested £340 compensation as per the regulations to be used on my next holiday!!! I would normally go for the cash but as it will go towards my next holiday i was more than pleased so thank you Martin as I probably wouldn't have bothered. One happy customer.0

Good Morning,
My partner and i went to India with Thomas cook last November - we were delayed approx 4 hours on our return journey back to Manchester, UK. The reason for the delay was that the plane they were using had just been used for another route and was in the hanger longer than they expected changing the configuration of the seats!
They said over the tannoy that this was out of their control but just wondering whether anyone thinks its worth putting in a claim?0
