My take on the reason he has written these letters is that he is as busy with claims as he could possibly be and is simply picking the fights he knows he can win without too much hassle. I haven't heard this from the horse's mouth but am assuming the obvious.
That is not to say the individual cases he has turned down lack merit and may be pursued with another NWNF company or on one's own if one is so inclined.
My observation relates only to his use of archaic flowery language. These days solicitors are trained to speak in plain English and students actually fail drafting exams for talking like that (the grade is known as 'Not Yet Competent' in the LPC).0 -

I would only add: why effectively sit on this for six months, without advancing the claim at all? I share the frustration of the OP, which doesn't feel unreasonable. If flightmole has taken on too much - which is my assumption - they need to close the store until they regain capacity.0 -
Have today had a call explaining mediation and trying to set it up for when I'm available. Has anyone got to the stage I'm at and still received payment from Virgin before mediation or before a hearing?
Also if it does go to mediation or a hearing what should I be collecting evidence wise to support my case. Their defence is based on technical issue and staff legal hours. Thanks again.0 -

Post on airline specific post. Plenty of posts regarding mediation on the various threads.0 -

You need to show willing and turn up for mediation as that is one of the court's favourites at the moment. If you case is like most then you will be in the right and you just need to stick to the facts.Jillsa0

Hi
Just looking for some advice please.
Returned yesterday from an Olympic holiday and was subject to delays of around 4 hours.
I have reviewed the ‘guide/ checklist’, but just had a couple of queries which I would appreciate if someone could please clarify, before I send my letter.
1. The flight was scheduled to be with Small Planet although we actually flew with Avios Airlines. Do we end the letter to Small Planet or Avios?
2. The original flight number was changed – do we refer to the first or latter or quote both?
3. The flight should have departed at 15.55 from Zakyntos (Zante) airport, but did not take off until around 19.55 (we had been told departure would be 19.30). We should have arrived back to Birmingham at 17.25 UK, although it was actually around 21.00. I have tried to establish the exact arrival time at Birmingham Airport via www.flightstats.co.uk but this does not show the flight leaving Zante or arriving at Birmingham!! Before submitting the claim is it worth phoning Birmingham Airport (there does not seem to be an email address) to see if they can confirm?
We weren’t told of a reason for the delay – after being picked up just before arrival at Zante Airport we were advised there would be a 2 hour delay. Once at the airport we were advised an alternative plane needed to come from Dubai, we were later told it was coming from Athens, then finally it was coming from Birmingham! We were advised that check in would not be agreed until after the flight had departed from its destination. We were not offered food or drink at the airport – I even asked at the Olympic desk and was just looked at strangely. Looking at http://forum.airlines-inform.com/Small_Planet/20.html (such a shame I didn’t find this before I booked!!) it looks as though the flight out from Birmingham to Zante was delayed by around 4 hours and when it arrived we were most likely put on this one to get back home.
Has anyone been successful in their claim against Small Planet?
Many thanks for your help0 -
