I did ask if I had missed something, as we thought that county court judgments did not set precedents that was only high court????? and how could one small claim for a couple of hundred pounds cause such an effect? she totally ignored me the judge just smiled a very wry smile.........
he did make reference a couple of times to the quality of my submissions and I just loved it when he held it up to show her open at the wallentin report and the relevant sections highlighted..........:T:T:T:T:beer::beer::beer:
Whilst by no means an expert am more than happy to give any help to others awaiting court, yes its a pain, but it is worth it........its just a shame not all judges are applying this new CPR 1 ruling.......

please do not be daunted by the thought of court, the devil is in the detail as they say, and my bedtime reading for months has been the report.......
my folder was all sectioned off with dividers in it, and on[STRIKE][/STRIKE] the front of each divider a list of what wa sin that section.........
Everything I was relying on highlighted and numbered on a separate sheet for the judge so it was all so easy to read and reference and not get DISTRACTED.............
THAT IS MONARCHS ACE INT HE WHOLE DISTRACTION AND DIVERSION......
I DOTN THINK THE IRONY OF HER BEING LATE WAS WASTED ON THE JUDGE, HE HAD CLEARLY THROUGHLY READ AND RE-READ MY INFORMATION COVER TO COVER AND KNEW THAT THE ARGUMENTS OFFERED BY THEM WERE WEAK AS HE TOLD HER......:D:D

I am really that the judge not only noted how unacceptable it was for Monarch's evidence to be submitted so late (how ironic is that?) but that the arguments they had advanced against your (Wallentin-centric) statement were so weak.

I'm so pleased for you - it is a well-deserved result. Monarch shamed again.
And the irony of their submission about their delay being itself delayed is priceless. You should have told the barrister to claim "extraordinary circumstances" ...
I think you are absolutely right about keeping the focus on the key points of the law. It is obvious that the judge had read your submission, and highlighting obviously really helped.

Maybe Monarach and some of the other airlines will take note that we the passengers are not idiots and are able to present a reasoned and sensible claim in a court of law and will not tolerate their lies and deceit.0 -

For anyone daunted by the legal process - it is simply a more formal and long winded way of having an arguement. As has been said, just get your facts right, have solid proof and present the information in a coherent and clear fashion. Theoretically (as has been proven in this case), if the Law is on your side you can't lose.
I cannot believe that Monarch PAID a Barrister to go to court and do that. Truly dreadful.

Arrived at court, Barrister phoned at 11.25 delayed in traffic going tobe late!!!!!!!!!!!
turned up about 20 mins late, then hands me a skeleton argument!!!!!!!!
My response was to laugh and say a little late!!!
enters court.......Monarch submission not with the court, Barrister did not have anything with her, totally ill prepared.
Nice Judge ask us, did you receive a bundle? .. reply, Yes

Judge not even 1 working day before the hearing, well I have nothing........Barrister Sir the statements and supporting documents were sent tot he court...

Might I remind you of the new rules in CPR 1 about how incumbent on all parties to follow the guidelines and time frames set by the court and its directions, now Mr & Mrs have done so, when did you serve this ont he defendant?
Me by the 24 June Sir recorded delivery and have the received receipt with me.....I also have the defendants statements with me if you wish them sir!
Judge Thank you but that will not be necessary, they are late and therefor excluded and as such judgment is awarded to the claimants.
She tried to argue them in, he just was having none of it, and well and truely put her in her place............ he lifted up my folder and showed her it, all the sections I was relying on highlights etc, etc......
She continued ot argue, he replied, if if I did allow itin at this late date, your evidence and arguments for ec's is to say the least very week.
But sir this case is very important to the industry and its result will cost the industry millions of pounds.......judge that has nothing to do with the claimants claim..........
the skeleton argument I will give you so you know what is in it......

Hello All.
Me and my boyfriend were delayed 3 hours and 37 mins on our flight from lanzarote to Stansted on 04.07.13 - TCX7125.
This was due to a problem with part of the aircraft. Has anyone else tried to get compensation for this delay? Let us know how it goes and we will keep you updated of our progress.
