    Small Planet Airlines

    A flight due to fly out this friday from LGW at18:20 has now had its flight time changed to 23:30 instead. Why would they need to change the flight time in advance? Asked for a reason from Olympic (who the package was with) and they were unable to give one. Does she meet the criteria for any sort of compensation?

    I was severely delayed from LHR to SFO and have written to BA for the compensation on 3 occasions (the first time in January of this year) but so far no response what so ever. Does anyone have any suggestions on how to take this forward?

    Small Planet are a charter airline. Sounds like Olympic had to change charter company last minute for some reason. Small Planet probably couldn't provide an aircraft at the original time.

    Yes, they'll be entitled to compensation if the flight arrives 2 hours later than planned (and from what you say it'll be about 5 hours late)

    Yes it does.

    Compensation for cancellations works like this:-

    More than 14 days notice = no compensation
    7 - 14 days notice and flight leaves more than 2 hours early OR arrives more than 4 hours late = compensation
    Less than 7 days notice and flight leaves more than 1 hour early OR arrives more than 2 hours late = compensation.

    Thankyou Coby Benson :beer: The booking t's and c's says that any "minor" changes (which includes delays of up to 12 hours) will not be compensated - do the rules you posted over ride this?

    Yes, these rights trump contractual terms.

    In fact any contractual term which seeks to vary a passenger's rights will be deemed void (Article 15 Reg 261/2004).

    Apparently Small Planet are saying that it is not a delay, it is a rescheduling due to operational reasons and therefore does not count! Pffft, lies?

    Ah, the old Monty Python defence. 'The parrot is not dead, it is resting.'

    This may well be 'a rescheduling due to operational reasons'. That doesn't stop it from also being an event triggering compensation under EC regulation 261/2004!
