For anybody going down the small claims route in Scotland you first have to prove to the court that they have jurisdiction over the claim. I used the following and the court accepted this.
STATE DETAILS OF CLAIM HERE OR ATTACH A STATEMENT OF CLAIM
(To be completed by the pursuer. If space is insufficient, a separate sheet may be attached)
I contend that xxxxxx Sheriff Court should have jurisdiction in this case for the reason I have listed below.
Civil Jurisdiction And Judgments ACT 1982 As Amended
Schedule 4 As Amended By Civil Jurisdiction And Judgments Order 2001
Jurisdiction over consumer contracts
8. – (1) A consumer may bring proceedings against the other party to a contract either in the courts of the part of the United Kingdom in which that party is domiciled or in the courts of the part of the United Kingdom in which the consumer is domiciled.0 -
I'd like to say a big thanks to MSE for helping us successfully chase compensation for flight delays.
In November 2008 my wife and I took a trip to Vegas as the second part of our honeymoon, unfortunately on the flight to San Francisco (where we were to connect to Vegas) my wife was taken seriously ill on the flight and was rushed to ER on arrival at SFO. We then spent the whole week in San Francisco, mostly in our hotel room or visiting various consultants, eventually my wife was given the OK to fly home and we arranged the flight, very much looking forward to just getting home from our ruined honeymoon. The final straw came when our flight home was delayed 18 hours by BA and we weren't even offered accommodation or subsistence of any kind.
Fortunately my wife is fully recovered now and we had excellent travel insurance which covered our massive medical bills - $3000 for a short ambulance ride from the airport to ER!!! The total bill for the weeks medical expenses came close to $10,000! Do not underestimate the value of travel insurance!
Thanks to MSE I've just received an email from BA Customer Services confirming they will be sending me a cheque in the next few days for the full 1200 euros compensation - maybe we'll use that money towards attempting the Vegas trip again sometime in the near future.
Thanks very much guys! :beer:0 -
Hi,
I wonder if I could ask for some advice, please? In 2008, my party of four, booked a holiday, in Bali, departing from Heathrow, with Qatar Airlines. Due to technical problems the aircraft take-off was delayed for 4 hours. We then left, but 3/4 hour afterwards had to return to Heathrow for the same technical problem. This time we waited another 7 hours for replacement aircraft. When we eventually arrived in Dohar we missed the connection to Singapore and were booked into a hotel at the Airlines expense. It meant that we lost the first 2 days of our holiday. Qatar Airlines paid for our expenses except of for taxi fares in Singapore.
Do you think this is a justified claim?
Have you any tips for applying for compensation, please?
Many thanks for any help you can offer.0 -
As per my 2011 post no.1209 does anybody think this is worth taking up again ?0

My local court just asked me to write on the claim form that as I had booked the holiday from my Scottish home address my local court had jurisdiction. Hearing on Thursday."Sometimes life sucks....but the alternative is unacceptable."0 -

Hi Again,
Please see post #6430
I'm sorry but it wasn't until I read through this thread that I understood where to find most of the information I need. Apologies for that. I'm 70 years old, this is my first computer and I don't know too much about how things work. Apologies for that.
I think I'm now ready to submit a claim for compensation, but can't seem to find where, within the Qatar Airlines organisation, I should send my email to. I've tried Googling but no joy.
Can anyone help me, please?0 -

Sorry that people haven't been helpful on here, it certainly sounds like you have grounds for compensation.
I couldn't find a customer service email address in the UK, I think in your position I would call their main ticket office and ask for the customer service address. Details in the link http://www.qatarairways.com/us/en/contact-us.page#

Thank you so much Fletchasketch. By using your link, I've managed to find a number for Customer Services, hopefully.
I'll 'phone them tomorrow for their address and will visit the Forum afterwards to leave any information I receive, which may be useful to other searchers.
I'll keep you posted and many thanks again. :T0 -
