    They can, but it might not be extraordinary circumstances which is what I think you really wanted to ask....
    ECs which could not have been avoided even if all reasonable measures had been taken? Then have the argument as to if it was beyond the actual control of the airline. Surely if the airline doesn't fancy shelling out compensation it is up to it to make sure that all agents, third parties etc., have necessary insurance, and or penalty clauses are built into their contracts. (right to redress Article 13).

    My family were delayed for 24.5 hours on a 7 day holiday to the Maldives in 2008. Hayes and Jarvis were the tour operator, but the flight was with Thomson airways. They have rejected my claim for compensation by stating that the claim is not within 2 years. This website is saying 6 years for claims so I am within the 6 yr limit. Who is right?

    Can I take them to the small claims court? Faulty door was the reason given for the delay. I didn't realise I could make a claim at all until I saw Martins money tips programme about 6 weeks ago.

    Any thoughts anyone on this?:(

    Your thread which lists known monarch delays and causes for delays is epic. Is it possible to start one for Thomson airways/TUI Travel? I'm happy to do so but feel very new to all this.

    Oh sorry BB I didn't mean for my response to sound unhelpful. I thought that's what you meant but it might also have read the other way. Centipede100 is really helpful and has probably misread it.

    Hi! apologies if this has already been asked, however i am still trying to find my way around this site!!
    im looking for advice please: I sent off two compensation claim letters two weeks ago, one to monarc and one to thomsons.
    What is the correct procedure i should follow now, and timescales? Is it first letter, second letter, NBA then Start court proceedings? I am not going to bother writing to the CAA as i believe it is a waste of time, going by other posts on this thread.
    Also, are there any template letters i could follow?
    Many thanks in advance.
