  • Afternoon all,

    Apologies if what I write below is a bit of an essay.
    Went on holiday to sharm el sheikh for a week.
    Coming back from Sharm El Sheikh was a night mare! We arrived at sharm airport on the 17th of may at 8pm for our 22.50 flight.. as we arrived the departures board said delayed till 00.50am..we went through security and then queued up at the check in desk and waited for an hour. the egyptian officials at the airport then came over and said we had to go back through security and wait by the airports entrance till our flight was read out on the tannoy! 45 minutes later we were told to go through security AGAIN and proceed to the check in desk. We were checked in and then went through passport control and another security point. We went down to the departure lounge and had something to eat and drink. If a flight is delayed 3 hours we should be given refreshments?? nothing of the sort was given to us! 1.30am came and an announcement was sent over the tannoy that the plane had landed and was just getting ready for us and then the pilot would call us on to the plane with in the next hour! the flight had now been delayed till 2.30am! by 2.30am another announcement came over and said that the flight was now cancelled as the pilot and cabin crew had done too many hours of flying! we were then shipped off to a hotel at 5am where we would have 4 hours sleep and then had to check out. To be fair they did give us a decent breakfast and dinner on our filght home. We went to the airport at 4 and finally we took off at 7.45 although we were suppose to take off at 7!


    Does anyone know if I am entitled to compensation as we did receive accomodation and meals?

    Hi Cityboy I was told I could e-mail the Thomas Cook pr by my local Thomas Cook branch where I booked the holiday, I got a mail back with a reference number & that they would answer my complaint as soon as possible but within 28 days.

    minor update on my story.

    The payment of £33.30 was stated by easyjet to be in payment of my additional expenses claim. I have challenged them to be specific as to which items they have accepted - and what conversion rate they used - the figure is only some £10 below the correct sum - but I am not prepared to be paid a sum - without being told how the figure has been calculated.

    The $250 compensation for a cancelled flight is awaiting the response from the Company Secretary to a recorded delivery letter.

    I have also written to the Chief Executive - bringing to her notice that her Customer Service department is a disgrace ( and should be exposed by a national newspaper) - as it quite clearly is instructed to be as difficult and obstructive as possible.

    Hi again I have had word back from Thomas Cook & they say a full investigation is happening as we speak :question: :rotfl:
    They will get back to me within 28 days if not sooner.

    If I buy tickets with an airline to connect in New York on a separate flight, but with a partner airline on Aer Lingus I'm careful to give 2 1/2 hours difference, although you go through US security in Dublin so no long queues at JFK.

    If my Aer Lingus flight is delayed for whatever reason and I miss the connecting flight would they be liable?

    really interesting topic. Had a relevant problem.
    3h45 minutes delay by Easyjet, was flying from Nice.
    Just phoned them and asked for compensation and I was told that
    it has to be cancelled I then quoted the EC law and mentioned the
    exception under extraordinary circumstances.

    I also insisted that there were no such circumstances: This is what the cabin crew told us! They were themselves annoyed and they weren't aware they should be on duty. They said that this was all due to mismanagement and they were also unhappy about it and told us to email the new CEO.

    I've managed to record the whole thing he said.

    Yet when I called, I was told that it was indeed extraordinary circumstances because "they had to swap crews" the crew had exceeded the "legal amount of hours on duty" so they weren't allowed to fly, and that's why they swapped.

    COME ON! don't they have schedules?? Don't they know this would happen? How on earth is that extraordinary??

    I don't know what's the next step for me. AUC?
    What about EUCLAIM has anybody used it? is it really effective?

    Posting this on behalf of a friend, not quite sure whether they are entitled to anything mind.

    Flying from Tenerife South to Newcastle with Thomas Cook, they were due to depart at 20.30 and arrive at 01.50 at Newcastle but because the incoming aircraft broke down on an earlier run they didn't actually depart Tenerife until 01.05 and arrived at Newcastle at 06.10 (not helped by some nasty headwinds)

    There were 4 in the party and they were each given 6e which didn't actually cover a sandwich in the one cafe that had stayed open

    They said the ground staff were very dismissive of any queries and it was actually the handling agent at Newcastle that told them why they were so delayed

    easyjet have admitted that by mistake they have paid in £ rather than euros - paying food and telephone costs in £ rather than euros - but limiting taxi to £20. They have now referred the taxi claim for $46 to higher authority as it was too large for authorisation at the level responding to my query.

    nothing on the $250 yet - but that is not surprising

    Well, Air France has said no.

    I contacted them through their on-line form following my 12-hour delay on 14 June. I asked for incidental expenses arising from the delay, and the 600 Euro compensation, making it clear that I would accept 70,000 frequent flyer miles instead of the money.

    I sent my claim on 13 July, and received a response today: profuse apologies and a credit of 6,000 miles. They deny compensation thus:
    I note your request for compensation and I would like to respectfully explain that the current Legislation in place does not contemplate compensation in case of flight delays, but only in the event of cancellations where it is outside the Airlines control or denied boarding. Consequently, we must regretfully decline your request on this occasion.

    For incidental expenses, they ask me to forward original receipts "to the address below" but don't give an address! (And what was the bloody point of asking me to scan and upload receipts with the original claim?)

    My response, written thanks to the excellent template letter and links that Cityboy has provided:
    RE message from Xxx Xxxx (named Air France staff member):
    1. Receipts for my incidental expenses were uploaded to you with the original form. I am surprised that you ask for them again, also surprised that you do not give an address for replies. If you need the original paper copies, I can supply them to the Air France office in Benin, where I am now. Please let me know if this is necessary.
    2. I also requested compensation. Your reply is simply wrong: compensation is due in this case under Article 7 of EC Regulation 261/2004 following the ECJ judgement in November in joined Cases C 402/07 and C 432/07 Sturgeon v Condor and Bock/Lepuschitz v Air France. I quote from the ECJ ruling: "Articles 5, 6 and 7 of Regulation No 261/2004 must be interpreted as meaning that passengers whose flights are delayed may be treated, for the purposes of the application of the right to compensation, as passengers whose flights are cancelled and they may thus rely on the right to compensation laid down in Article 7 of the regulation".

    Please EITHER pay the required compensation of Euro 600 OR credit my FB account with the 70,000 miles requested. If you are unwilling to do so, I shall unfortunately be forced to pursue this matter in the courts, and cannot be responsible for the additional costs that Air France would suffer as a result.

    Question for Cityboy: if they say no again and I need to go to court, how can I do this when I live in Africa? I expect to be back in England next April: would I be able to issue proceedings then, or would the case somehow be out of time?
