hi , don't know if i will be eligable for this or not ?
last year we were due to fly to spain fron bournemouth on the 6th of april only to find that once we arrived at the airport our flight had been cancelled !!! apparantley french airtraffic were striking for 2 days . ryanair ...( yes i know ) offeredstrangley enough though other airlines still seemed to be flying , i know for a fact that flybe did'nt cancel any of their flight and there was minimal distruption with us alternative flights , 2 days later from stansted which meant 2 days lost , extra expensive and inconvenience . strangley enough though other airlines still seemed to be flying , i know for a fact that flybe did'nt cancel any of their flight and there was minimal distruption with easyjet ??? will i qualifyi know for a fact that flybe did'nt cancel any of their flight and there was minimal distruption with easyjet

Perseverance pays off...
Three of us were delayed by 12 hours in March 2012 on a Heathrow to Toronto flight. After writing to Air Canada they replied that the reason was a technical fault which they deemed out of their control and therefore denied compensation. I escalated to the CAA who claimed not to be able to help at that point but advised keeping an eye on the ECJ appeal due to opine in the autumn last year. Seeing that the ECJ then confirmed technical faults were not deemed outside an airline's control, I wrote back to Air Canada in January this year quoted the judgement, included the previous correspondence and they have now paid us £522 each. Probably took me 3-4 hours in total effort, but 10 months later now have something to show for it. Thank you MSE for all the info that helped us secure this!0 -
I cant find my flight on flightstats.co.uk. I was delayed for over 4hrs (but im sure it was nearer 6hrs) from Larnaca to newcastle on 17/08/2011 with Thomascook airlines (tcx6109) Flightstats say there was no flight but i no i was definately on the flight as i had to collect my sister from ayia napa in an emergency. I also put my detailsinto EUclaim Advice and it says my flight was delayed but doesnt give any time length. I dont have any paper work or boarding pass with flight details etc. But i do have bank statement with payment on for the 2 seats back to newcastle & a transaction from the airport on my statement.0

I had a 6 pass anger payout from BA on flight from London to Tampa and today received a pay out from virgin for 4 passengers on a June 2908 flight from Orlando to London. Only downside is virgin used exchange rate from 2008 so got a bit less than BA.Self confessed Florida expert
with over 320 trips there!

Great news. I got £195 compensation from British Airways for a BMI Baby flight from Cardiff to Edinburgh that was cancelled in JULY 2008. Thanks Martin. Don't ever leave us for sunnier climates...0

That, unfortunately, is the correct method.
But AFAIA, you're the first person to receive compo from Virgin, from a denied claim, that they changed their minds on following the issue of court action.

In my original complaint against Thomas Cook they directed me to the AESA in Spain, as the delay happened in Spain. Recital 22 of EC 261 states "Member states should ensure and supervise general compliance by their carriers with this regulation and designate an appropriate body to carry out such enforcement tasks"
As the AESA found in my favour, and TC still refuse to respond to them, or pay the compensation they say I am entitled to, should the CAA not be prepared to get involved.
Hi Maghater, Centipede is right court action is the only course of action. I like you went via the AESA Spanish regulator, like you my claim was upheld by them, this is back in October 2011, but I could not issue legal proceedings until after final EU judgement last year. This was against Iberia, so commenced legal proceedings on 1/11/2012, have a final hearing Court date of 30/4/2013. Iberia ignored AESA report, ignored certain correspondence, changed excuse three times, and are utterly arrogant. Best of luck with persuing your claim, do not let them of the hook.0 -
hello has any one got any thing back from this the flight was on thurs may at 15.30 to faro from manchester i did complain when we got home but monarch just said no it was over 6 hours delayed0
