Monarch told us that over a delay of 8 hours from Malaga. A court has since ruled that technical faults do not constitute exceptional circumstances in two different proceedings. I have written back pointing this out and asking them to reconsider our claim and that if they refuse compensation again it will precipitate court action which will cost them substantially more. Lets hope they see sense.0

My flight was delayed for 6 hours and also diverted. I flew with Viking Airlines in 2010 although they are no longer trading. I see from the original post thatIn this instance, you may be a creditor of the company and in that case you would need to make a claim to the liquidator or administrator.
how exactly would I be able to find out who the administrator/liquidator would be? I can't seem to find any information regarding this0 -
...just speed reading thru this thread.....I was delayed by just under 24 hours on a holiday in DR in 2010 because our original Thomson flight returned to Gatwick after pieces of rubber were discovered on the runway. The assumption was that a tyre had burst. My original complaint to Thomson for compensation for a loss of a day's holiday was rejected - they claimed "technical fault" ie burst tyre - if I put in claim I assume that they would now say "safety issue"??0

My family and I were delayed 15 hours on a Thomas Cook flight in October 2010 from Tenerife to Manchester. I made a claim straight away but they refused to pay as they claimed EU law did not allow for compensation for delayed flights. After further correspondance they would not budge and mentioned legal action at the time was stayed due to the airlines going back to the European court.
After the further ruling last year I again wrote to TC this January and two weeks later I received a voucher for £1260. I emailed them confirming I wanted a cheque not vouchers and a week later the cheque arrived as settlement.:)0 -
Has anyone here had success in getting compensation using this scheme for the volcanic ash cloud over Iceland a few years ago? I was stuck in Paris en route from Delhi to Birmingham using Air France for around 3 days, just wondering whether it's worth pursuing for compensation. I'm guessing I probably won't be able to as it may be classed as a natural disaster.0

I've not heard anything back from BA, been just over a month now. I sent the letter recorded.
I've emailed their customer relations to state I've had no response and if they don't acknowledge within 7 days I will go to the CAA.
Are people at least getting acknowledged from BA?0 -
My family and I were delayed for 12 hours on our return flight from Menorca in 2009. We were given a sandwich and a drink each in the entire 12 hours! Unfortunately I have no records of the holiday, is there any way I can trace the details?
