Was your flight cancelled because of the Volcanic ash?

Where you looked after with hotels and food?

I have just returned from a weeks holiday in Greece.
Our tickets stated that we were flying home 1.5.10 at 01.15 and that check in opened at 11.15 on 30.4.10.
On the third day of the holiday the rep put a not under our door stating we were now leaving on 2.5.10, no explanation given!
It seems there was a printing error on the tickets. We were made to check out of our rooms at noon, leaving us with no accomodation until the flight departure some 13 hrs later!
In effect we suffered a 24 hr delay and no compensation food, drink or accomodation!
I am going to try and claim from the tour operator as I find it totally unacceptable and poor service!
Has anyone else suffered anything similar and made a claim??
  • I was due to fly out to China via hong kong on 12 April to get married on 20th but due to the volcanic disruptions my flight was cancelled. I took the option of another flight rather than a refund but the earliest flight i was offered is 10 May. This has cost us a great deal of disruption and I was wondering if anyone thinks I can get some compensation from cathay pacific for this. Paul

    HI,
Sent my letter to Jet2 on the 28th to the customer services address at Leeds/Bradford Airport. Just checked and it's been signed for on the 29th. I gave them 10 days to respond therefore what course of action should i take if i get no responce from them?
    Thanks

Yes it was, it was for accomadation + meals only

Bearing in mind that the following is from the Jet2 website:-

For those customers whose travel insurance does not cover this situation, Jet2.com will consider further options for passenger claims as the situation becomes clearer over the coming weeks.

Don't you think 4 weeks is a bit much? Can i charge interest on the amount owed as i will have to pay it?

We're (3 of us - adults) have decided not to pursue any claims for our 1 week delay/stranded as we were probably only £150 'out of pocket' and that was down to extra car parking at Holiday Inn at Heathrow and also my husband's hotel & train fare from Birmingham (he managed to get an earlier flight home from LA 2 days before ours).

I think we'll put it down to experience and, after all, £150 for an extra week in California for 3 of us is a bargain! My sister hasn't sent us a bill for groceries yet though!! ;)

Jet2 are compelled to pay claims for meals/accommodation but to expect them to settle your claim in just 3 working days since receipt is unreasonable given the number of claims they are probably receiving.

If you don't want to wait you could issue a small claims action but that would only delay any settlement!!!!

Wait the 4 weeks and then recontact is still my advice.

I've actually given them 10 working days in the letter i've sent them to acknowledge the letter and give me a timescale for resolving the issue.

Once the 10 days is up i will send them another letter giving them another 5 days before i take this further.

The problem with Jet2 is that they have yet to agreed anything regarding claims etc

The regulations that apply in such circumstances are EC 261/2004 (link disabled). There was also a recent ECJ ruling that extended the compensation in Article 7 from cancellations to delays greater than 3 hours in arriving at your destination (link disabled).

That said, my previous advice to posters above also applies to you. You will need to take this as far as a small claims court to have any chance of securing compensation. Same advice also regarding legal expenses cover under your household insurance policy.

    Hi Cityboy,

Really appreciate your advice. Have now recieved response from Thomson so thought would update everyone and also get your thoughts on what to do next.

After intro etc this is the main paragraph...

... With regard to your request for compensation for the delay you experienced, we don't support the recent decision of the European Court of Justice as it conflicts with superior decisions already made. The ruling is vague and possibly makes the whole of the EU regulations invalid. We do not therefore recognise that the law requires compensation to be paid in the event of a delay. However we will offer all assistance to the appropriate EU and national enforcement bodies to clarify this matter....

They then kindly offer a £25 voucher off our next holiday with them as our seatback entertainment didn't work for the outward journey!!

This is the first response i have had from Thomson from my first letter and this relates to a holiday 23 March and not to do with volcanic ash.

    Thanks
    Kev
