My Ryanair flight from Malaga was cancelled on saturday morning. While I was happy enough to stay until the next available flight (monday night) my travelling companion wanted to return and so we booked a jet2 com flight (this airline among others was still operating). This flight was due to leave at 8.30pm but was then delayed until 1.30 am. Looking at the helpful advice on the moneysaving site I seem to be able to apply for compensation for both flights but I am wondering if airlines will get out of paying because of the 'exceptional conditions' - does anyone know if this is the case? The airline numbers to call are 50p per minute which is an added !!!! off. I was insured (with a Which? approved insurance company) but because it was a return flight they said it's only counted as a delay and because the delay was less that 12 hours betweeen first one and finally leaving (it was 11 and half hours) I am entitled to nothing. On top of that I came back to a parking fine on my car...:( Any advice gratefully received...0

City Boy, re the above reply.... if you have taken out insurance for the two weeks and you're stuck in somewhere like the Dom Rep for a further week due to something like volcano ash, are you covered for insurance by your own company or does someone like Thomson cover you for the week you're stuck there please?

Thanks again Cityboy.... one more question please... I've looked at Bell for insurance and it's less than half the cost that Thomson wanted to charge, but there's an optional charge for 'Excess Waiver' which is about another £10... Is it worth paying the extra or not?

Hi guys
Currently my gf and I are in NY and are due to fly home to Manchester tomorrow evening 10pm NY time. As it is looking likely that the ash will close manchester airport and cancel our flight. Will expedia cover the cost for the extra nights at our hotel? We also have insurance with flexi cover direct which was booked in feb 2010, are we covered through them also? We have no idea what to do?

So after many, many emails and letters to easyjet, I've finally succeeded in getting a refund of my original flight and the new flight I had to buy. And this morning I discovered that they are going to pay the compensation of 250 euros. I had to take them to the small claims court to get the compensation but they didn't contest it and I asked the court to issue a judgement against them. easyjet (and I'm sure the other airlines) love to use delaying tactics in the hope you'll give up - don't. It's taken 5 months but I've got nearly 500 GBP from easyjet so it's definitely worth sticking it out.I had my flight cancelled by easyjet before Christmas and I want to know where I stand regarding compensation.
I was scheduled to fly between luton and belfast with easyjet on december 20th. I arrived at the airport in plenty of time (2.5 hrs) before I was due to leave to find my flight was cancelled. When I went to the customer service desk I was told that there were no flights available until after Christmas and I was given I number and website address to get a refund - I was not told why the flight was cancelled. Now, I know there was issues with weather but I do not believe this was why my flight was cancelled. Firstly, the other easyjet flights from luton to belfast did travel (one was boarding when I arrived at the airport) and secondly, surely if it was weather related they would not cancel that fair in advance - how could they know what the weather was going to be like nearly 3 hours down the line. Also, as far as I could tell no other flights were cancelled out of luton and belfast was open to flights all day.
I managed to get a flight with aer lingus from heathrow the following day but it cost me an additional 250, that I really could not afford and I got to my final destination approximately 27 hours late.
I know I'm unlikely to get anything out of easyjet but I don't see how they can claim they had to cancel the flight!0 -

I have sent off my receipts for incurred expenses when we had to stay an extra week in Malta in April. I have also filed a claim for compensation as we were told our second flight on 21st April was cancelled and we were made to rebook but our flight became 'uncancelled'.
We were due to fly home on 21st April at 7pm but on 20th April the Air Malta website had the flight as cancelled. I phoned them to check as airspace was due to open at 10pm that evening, 21 hours before our flight was due to leave. I was told that our flight was DEFINITELY cancelled and not to wait until morning as it wouldn't change even if the air space opened. We were made to rebook for 28th April. However the next morning (21st) the airline website changed to say all scheduled flights would leave as planned. I phoned again to be told we had rebooked and therefore had lost our seats on the flight for 21st. I argued that I wanted to wait until morning but was told no the flight was definitely cancelled and was made to rebook. Can I claim for 'denied boarding' or is this too obscure a circumstance? My argument is that the airline could have prevented cancelling our flight by leaving a decision to cancel until the 21st as they obviously made the decision too early and reversed it.

Thanks Cityboy - I guessed it was a long shot but thought it may go towards covering losses that we can't claim for like loss of earnings for the week and tickets for a show which we missed etc.0 -
If Thomson won't play ball, when they clearly owe Kev the compensation, then can he not tell them he'll contact the AUC, who will want to fine Thomson £5k for not compensating? I would have thought that the airline would then rethink its decision??

Whether or not Thomson support or recognise the decision of the ECJ or not is really neither here nor there. That decision is precedent law and as such cannot be appealed to a higher court (ECJ is the highest law court in the EU!).
What you decide to do now is up to you. If you have legal expenses cover from your home contents insurance policy that could be used to indemnify you against any costs arising from preparing and making a legal claim in the small claims track of the county court with legal representation.
If you don't benefit from such legal expenses cover, you can make the claim on a DIY basis yourself using moneyclaimonline.

Just found this thread. I am about to make a claim from my insurance company, but now wish to also claim compensation from the airline. My question is, will claiming on the insurance (approximately £20) invalidate my compensation claim from the airline?

Compensation for a flight of over 3500 miles, delayed by more then five hours.
I'm guessing that the compensation is separate to the insurance claim, so trying for both is acceptable?
