I list the last 4 months of bird strikes from a web site which features a low percentage of the recorded strikes.

In the meantime write to the CAA so that you have some sort of back up of the tech fault by the time you reach court. The reply will take several months, but the court date, if defended, will also take that long.

What do i write to the CAA? What will they give me to back it up? Will they look into the fault on the plane.
Im not really bothered how long it takes but due to their heel dragging and general poor Customer Service im not letting them back me down so easily.

In aviation terms I - incident, A - accident, C - crash. Generally incident basically means something (often minor) happened, accident means someone received a small injury or in this case, more likely, slight damage occurred to the plane, crash means, again, in this scenario a bird strike caused the plane say to leave the runway on departure although it doesn't mean major damage. For other reasons I am currently investigating the percentage of technical problems mentioned on this website (to back up rejection of extraordinary circumstances) and most of the airlines (suprise suprise but not unexpected) do not log a high percentage of 'mishaps' akin I suppose to how many of us report a scratch on our car ie why should they?
Therefore the list of bird strikes I copied is only a small percentage of the I A or C's that occured.0 -

This is a typical refusal response, from presumably Iberia Airlines. They are fully responsible, and cannot utilise that get out, EU261/2004 is clear, you are entitled to compensation defined, as dependent on how late was your arrival at the final desitination. Clearly scheduling, and the running of aircraft to timetables, is within the control of the airline. I would continue to persue your ligitimate claim, however I suspect it will be a long drawn out battle. Get the CAA to take it up with the Spanish Regulator the AESA, who will investigate, and define what it considers to be either upholding your claim, or rejecting your claim based on their full investigatio. They write to Iberia, ask for the specific details, investigate, then make their judgement, this will be useful if you have to proceed to Court like me. Note: they have not claimed Extraordinary Circumstances, or technical reasons ?.
As youu not have specified dates, from your information you appear to be outside the UK legal timev limit of 6 years, not sure what the Spanish time period is, so you might well be out of time period.?

Thanks for the contributions on here, I've done my template to Thomas Cook Airlines and will be sending off today. Only small detail was that I couldn't find my booking reference number, but they should have records, right? It was back in 2008 after all.
My sister in law (also on the same flight with her fam) will be sending a near identical letter at the same time so hope that doesn't jeopardise things. I had to share this info with her.0 -
I see from the FAQ (thanks blindman and Mark2spark) that a small number of claims have been conceded by some airlines though with mixed information.
This got me wondering what criteria airlines are using to choose where they pay out and where they don't.
The cynic in me guesses that they may even concede to some passengers in a flight and not others depending on how hard you fight your case.
It might be useful to record the flight numbers and dates for all cases where the airline concedes if possible. I guess that depends on the consistency of people reporting successes of course.0 -

There were no delayed flights from EFL on 26/6/11 as far as I can see. Where were you flying to?0
