TC is an EU based airline and the flight was to an EU airport therefore im afraid that your wrong.
Rusty: you need to read my post on this page which states what you should do. my claim was successful with Thomas Cook however I was just persistant.

From what I have read on here the CAA seem to be somewhat 'toothless tigers' and dont seem too anxious to get involved.
I think the time has come to see what the judge has to say.I started out with nothing and I still have most of it left!0 -

Thank you, I will try again. The first flight was cancelled due to the dreaded technical difficulties. Maybe they will up their offer of 100 Euros flight credit to enough to actually get anywhere.

Following the failure of Icelandair to respond to any of my letters, I referred the matter the British Civil Aviation Authority whose advice is to write again to the airline. It would appear that Icelandair are adopting a 'no response' policy, so would the next step be to instigate a claim through the small claims court? The CAA point out that as the ruling has not been enshrined in European Law they cannot enforce a compensation payment. Thoughts?0

I have sent a claim into TCA for a flight delay in Las Vegas (Jan 2009) where they had no flight crew to fly the aircraft, we where informed they where stuck at another airport, however regular passengers expected this as it was tier last flight of the year and had happened previously. lets see their "technical" explanation of this, will keep u posted0 -

I never thought I'd stick up for Easyjet, but having been delayed 3hrs 45mins from geneva to luton on 27th December, I emailed them a copy of Martin's letter the following day, and they have already confirmed in writing that they will be reimbursing me and my fellow passenger the full amount we are entitled to. I am amazed and delighted at their acceptance of my claim and the speed at which they have responded to it. Many thanks Martin for the standard letter and all other relevant information.0

Well, in my case after easyJet refused to pay me compensation, complaint to CAA apparently made easyJet to realize that they better pay me before I go to the court with this.0 -
I am currently awaiting a Court date in respect of my claim against Monarch Airlines for a 26 hour delay. Monarch are stating the technical problem experienced come under the heading of extraordinary circumstances. With the help of Centipede and others I am preparing my statement to go before the DJ later in the year.
In carrying out my research however I have come across a factor regarding my 26 hour delay which I have only just discovered namely that my return flight number was amended slightly. I was due to fly back on flight 959 but as this was a daily return service this would have meant two Monarch flights leaving at approximately the same time with the same flight number so our flight number was amended to 959B. I assume this makes no difference to my (delayed) claim however thought I should check as I was booked on 959 so did this become cancelled and become 959B as the cancellation provisions differ to the delay ones? Given the obstacles put in my way so far I am anxious to 'get it right'.0 -
