  • I was delayed on a Virgin Atlantic Airways flight from Delhi to London back in 2008. It was initially delayed due to technical problems and then was eventually cancelled.

    The technical problems were only announced after we had boarded the aircraft - so we were held on the plane for several hours whilst the engineers attempted to fix the problem.

    After about 4/5 hours we were taken off the plane and offered either a hotel for the night or to wait for an alternative flight with another carrier. I finally arrived in London on a BA flight more than 12 hours later than expected.

    At the time we were offered 25,000 Virgin Flying Club points which I accepted.

    What I want to know is, do I still have a claim after accepting the points? And is it worth pursuing?

    If anybody can advise, it would be most helpful.
  • I received the following reply from SAS to the standard letter:

    I certainly understand that the cancellation of flight SK*** on * December caused you a great deal if inconvenience. Our colleagues rebooked you onto flight SK*** which was due to depart at 2 hours and 20 minutes later than scheduled. I have checked the flight records and can advise that this service was delayed departing Copenhagen due to Air Traffic Control Restrictions which were in place, as well as a delay in the ground handling which was impaired by adverse weather conditions. In these circumstances, I regret to inform you that compensation is not payable, in accordance with EU Regulations 261/2004.

    Is this correct? I understand that the delay of the second flight might not be eligable due to the adverse weather- it was snowing rather a lot, but the cancelled flight delayed me.

    Any ideas how to word a counter argument?
  • We flew to Rhodes last May using Strategic Airlines. We were delayed for almost 12 hours at Manchester.
    Having just learned that the EU Courts have dismissed the airline appeals against their 2005 ruling regarding compensation, I am looking at trying to get compensation, but have just read on another forum that Strategic have gone bust!
    Does anybody know if I can still make a claim, and if so, to whom should I make it?
    All advice appreciated.

    My partner,son and myself were delayed in Palma in July for nearly 12 hours, due to a fault with the planes wheels. It was the longest delay I have ever experienced. Would we be entitled to claim anything back ? The reason the delay was so long was that they had no big planes able to fly from the uk to bring us home and they had to fly an engineer out from the uk ? The service was terrible no one from monarch was available simply the airport staff, we did receive food vouchers but little compensation considering the delay.

    Can anyone help point me in the right direction ?

    Sounds like you should be able to claim compensation.

    First, send you complain to the airline see what they reply.

    Normally they refuse to compensate, in this case you will have to forward your complain along with airline response to the air regulator of the departure country (see details in the article).
