Thanks Centipede and others for the advice.
I appreciate that a Court claim would elicit the reason for the delay, but would it not have cost me money to perhaps be told that the circumstances of the delay were "extraordinary" ???
Is there any other way of finding the true cause of the delayed flight?I started out with nothing and I still have most of it left!0 -

Just had a look on here again a bit more and a few people seem to be complaining about the amount of time it has taken to get a response from the airlines. My claim was with thomas cook who are an ABTA member. On the abta website, it states "
ABTA Members are required to acknowledge correspondence within 14 days of receipt, and to provide a detailed response to any letter of complaint within 28 days of receipt.".
I waited until 24 days before I sent a chaser email (making sure i copied in the Directors office, [EMAIL="dob@thomascook.com"]dob@thomascook.com[/EMAIL]) explaining that I still had not received a response and that I would complain to ABTA as soon as the 28 days limit was reached. Needless to say it took a matter of minutes to get a response.
Just a few general points, my claim was successful for two flights in June 2010 (over 2 years ago) and I had no documentation what so ever.
if you find yourself wondering whether you should claim, you should just claim anyway. The worst that will happen is that they say no. Just remind them of their rights as an ABTA member.

I have now had 2 refusals for compensation from Thomas Cook for our 5 hour delay(i was advised by CAA to contact TC again before they would look into the case) on the grounds of a technical problem which they class as extraordinary circumstances. I have now passed on all info to CAA & hope to get a good outcome from them, fingers crossed.......again0

When we eventually boarded we were told by cabin crew that our plane had just been flown from the UK & re fuelled as the original aircraft had 'some sort of problem'.
Although I am willing to go all the way via MCOL I am loathe to do so without written confirmation from TC as to their reason for the delay.
Any suggestions???

Given that your departure is outside of EU, the airline won't compensate you anything. Neither the court will.
TC is an EU based airline and the flight was to an EU airport therefore im afraid that your wrong.

I have finally received an update from Thomson regarding my 6 hour flight delay. They have sent me a form to fill in for each passenger and i' ve to send it back with a photocopy of each passport and the email confirmation booking they sent. The for asks for personal details plus actual dates/times of arrival/departure etc. The form states they will look into it once received back and to expect a reply within 56 days. Im sending them off this weekend so i'll let you know what the outcome is. Fingers crossed for something positive.0

I found it most interesting.
However if TC dont take any notice of the ECJ I doubt whether they would bother too much with ABTA if they thought it would cost them money!
