Why did you not look at the FAQ? One page back
hi Blindman, Of course I did and I appreciate your continuous work on this forum and developing FAQ.
I did not find answer to questions however in FAQ, I have posted (Q1 and Q2) + I was not sure, if all terms I used, sounds OK in English (I am not native speaker)
  • Hi
My partner and i flew with Thomas Cook from Cancun to Gatwick, the flight was due to depart at 1600 but left at 2011 (4hrs 11mins difference) and was due to land at 0750 but arrived at 1106 (3hrs 16 mins) i got these details of Flightstats. The captain stated that they had to wait for a pilot to travel from Bristol to Gatwick, so i am pretty sure my claim is valid. My question, is the delay from take off or landing.
Thanks in advance for any help

Just wondered has anyone here ever got anywhere with Lufthansa or the LBA (German CAA)?

It's your arrival time that matters when calculating the delay.

I doubt that you will get anywhere with LBA. They state on their website that you can launch an official complaint with them (what I am about to do) but they will not support you in any way with your claim. So, even if you send the complaint, it is unlikely that you will hear ever agin from them.

I sent my letter off on 7th Nov and rec'd my rejection letter back on 23rd Nov. I have sent an email to CAA this morning :)

Just wondering what your CAA email said? I got a rejection letter and I am wondering whether its more likely to be a quicker process emailing CAA or asking my travel insurance to pursue the claim on my behalf?

    Thanks

Sent two separate claims around 11th November and received a reply today. They are attempting to fob me off though because our delay was 2 years ago.

Success with Emirates after a 3 hr 50 delay in Nov 2012 - compensation paid of approx £240 (€300) as it didn't quite hit the 4 hour mark. But yay to the money back and yay to Emirates for dealing with it promptly and fairly.

Going to lodge court claim today and need to know a couple of thinks please:
    1. Is it acceptable to just make the claim (fill in the papers) in my name - i.e I don't need to put both of our names (2 travellers) on the form.
    2. When calculating the interest, I take it from the day the delay happened up until today...is it? (the date I submit my claim) Or will the court work out what interest will have accumulated by the time it gets to court?
    3. Documents to back up my claim - letter explaining delay from TC, ECJ ruling (do I need this too?), travel itinerary, receipt for travel (would I need this too?)
    4. I wasn't able to claim for the loss of one nights accommodation (because we arrived a day later) through travel insurance and I didn't put it in my original letter to TC. (I didn't know I wasn't getting it at that stage). So...can I now include this in my court claim as I still feel that it is TCooks responsibility to compensate us. I didn't put this in the correspondence with Thomas Cook, but hoping that doesnt matter.

Whats your opinion on the way things are going at the minute? It seems a lot of people are having to go down the small claims route - do you feel that this will be successful i.e. will T Cook, in my case, back down before the court date?
The sheer logistics & cost of having a court hearing in Belfast makes me wonder if they will relent sooner - here's hoping.
    Thanks
