    are there any judgements/guidance anywhere as to what constitutes 'extraordinary' in relation to airline's possible defence. In my case they are saying that it was a 'weather radar fault' and so I haven't a clue if they're right or not as to it being 'extraordinary'

    look at flighstats and see if other flights were also affected at the airport at around the same time.

  • As Richardw has already stated, the airline are incorrect. If that is their sole defence, then issue a Notice before Action right away giving the airline 14 days notice or you will proceed to issue a legal claim. Do state that you are aware that their previous letter contained an incorrect interpretation of the law.

    Thanks to both you and Richardw for some great advice. I always expected to be knocked back after the first letter but I didn't expect them to say they would not even consider our claim. I will do as you say and keep you all posted.
  • Having followed this 'forum' for some time it seems that there are serial offenders in respect of 'silly excuses' for denying reasonable and genuine claims. Thomas Cook, KLM and Monarch spring to mind. Does anyone have the IT ability to publish a league table of these offenders?

    Can anyone tell me how long they waited before any they received any response (if any) from TCA following their initial letter of claim?
    I started out with nothing and I still have most of it left!

    I have just sent off three claims for flight delays two to Jet2.com and one to Ryanair.

    The delay stats are available for the Jet2 flights but the Ryanair flight is not coming up. Have Ryanair the ability to remove the details of delayed flights from these databases by, for example changing the flight number after the event? Or am I being cynical!!

    The above idea could be imposed quite easily.     Don't think TCA are answering many people. I sent my claim on 30th October -28days tomorrow- to date I have not even had a acknowledgement, now wondering what to do next. Our flight on 8th October was delayed by 9hours, the Captain informed us it was a Computer problem. We were left sitting outside Corfu airport not allowed into departures until the flight had left Bristol , when we eventually got on 9 hours late & nearing Bristol the flight was diverted to Cardiff bad weather at Bristol. no telephone calls offered, they did give us a snack. We had to wait for coaches to transport from Cardiff to Bristol, the coach driver got lost & we got home approx 12 hours later than we should have done. Had we left on time we would have been able to land at Bristol.
    Any ideas what I should do next, can't see us getting a reply tomorrow.

    Sent two separate claims around 11th November and received a reply today. They are attempting to fob me off though because our delay was 2 years ago.

    I gave them 14 days to respond.
    That time is up tomorrow.
