Hi Centipede thanks for the info and advice along the way. Is the next step to send off my letter before action, (on the basis that the judgement is in) giving xx days to respond?
How many days is reasonable to give them to send payment?
What interest rate should I calculate from day of delay (19th Sept.) and do I say what it is i.e. a specified figure, up until the day I send the letter in, or do I say 'interest to be calculated' based on the date they pay me? and give them the % rate. Thanks
I have given Monarch 7 days to pay up otherwise its money claim on line which levies 8% interest calculated on a daily basis.0 -
Thanks 111KAB, money claim seems to be for (I presume) England & Wales. The court service here in NI seem to be the same though.

Monarch took 19 days to reply to my last letter which was just about ok however if interest is calculated from the date of delay until settlement then unless you are hard up for cash where else can you get 8% return on your money!0 -
So I could claim the euro exchange rate on the day of my delay and not today?

Good news on the ruling. Do you think it's likely they would claim Pilot sickness as an extrodinary circumstances? I mean I know they would need to get another one.. but waiting 15 hours for a replacement seems a bit extreme and I personally wouldnt call someone getting ill "extrodinary", statistically it happens to everyone everyyear...0

Good Afternoon
First post here, please be kind if i dont do it right...
Looking for some advice on a delayed flight:
Was due to fly from LHR to HKG in January with Cathay Pacific. After sitting in the plane, on the tarmac, for 6 hours the flight was cancelled due to a fuel leak.
We eventually left 27 hours later, with a new plane, although the flight was the same number but with a "D" after it.
Cathay are claiming this as a delay, not a cancellation, is this right?
I wrote to them asking for compensation a few weeks after the flight and this is what they said:
"Please kindly note that your request for compensation under the EU Regulation 261/2004 applies to the cancellation of flights and denied boarding. Flight CX252 on 28th January 2012 was regrettably delayed until the 29th January 2012 and departed London Heathrow at 1554. You may be aware that, in the UK, claims under EC Regulation 261/2004 for compensation for delay are being stayed by the courts pending determination by the European Court of Justice of an ongoing legal case on whether such compensation is properly payable pursuant to the Regulation. Pending publication of the judgement in that case, we are therefore not in a position to make any payment to you at this time."
Now the that final judgement has come through is it worth me sending them another letter? How would i word this one?
WHen asking for compensation i should use the exchange rate for the day of the original flight? What do people mean when asking for interest?
Any help/advice would be great as i'm not sure what I am doing

"Asking for interest" means that a claimant has issued a small claims track claim and is applying for statutory interest to be added to the amount claimed. In the case of flight delays, this is likely to be worthwhile particularly if your claim predates the legal "stay".
"...I'm not sure what I'm doing". Read the above advice again and if in any doubt about whether or how to proceed, you might like to hand your claim over to a handling agency!

I have checked with my insurance provider and they cannot help, and as i paid with a debit card i can't get any help there.
I will start by writing another letter and waiting to see what happens.
If it then gets overly complicated or they just refuse, i will then consider going to a claims company
