    search this thread for "sturgeon" and the date mentioned.

    Also search this forum about how difficult it is to get compensation, even when you may be entitled to it.

    A little bit of advice/ help would be greatly appreciated. On 17th June 2012 my wife and I travelled from Manchester to Ibiza with Jet2 on flight number LS169 scheduled to depart at 1600. However the flight was delayed then at 19:00 we were told that we were being diverted by mini bus to East Midlands where we would fly at 22:20. After checking in again at East Midlands Airport the flight was then delayed until 23:20. In total we were delayed over 7 hours.

    I wrote to Jet2 using the template that was posted on these forums and have just received a letter back as follows -

    "Upon reading your letter i understand you believe compensation may be payable under the EU regulations 261/2004 and refer to the current ECJ case C-629/10. Unfortunately, I cannot provide compensation in this instance as you rflight was delayed and not cancelled. After 5 hours, had you chosen to abort travel on this flight and purchase a new ticket with an alternative airline you would have been entitled to a refund of this sector, however no compensation would be due.

    It is our responsibility as an airline to ensure all passengers arrive at their chosen destination and arrive home to their original point of departure. This can be by any means necessary. On this occasion you arrived in Ibiza onboard your scheduled flight albeit at a later time than anticipated.

    If you wish to make a claim on your travel insurance we will be happy to assist you by issuing a letter to confirm the delay."

    So what do i do now? Am i best to wait for the verdict on 23rd Oct? Or are they correct in what they say and the only way i could get compensation regardless of the sturgeon result is through travel insurance?

    Any help would be appreciated.

  • I have a question with regards to post 1941 by Centipede100.

    If I understand you correctly, you can claim your compensation in an English court, but you need a British address.
    What if I don't have access to one? My plan would have been to go to small claims court in Canada, where I live, but I always figured that it might be hard to get my money even if I would win the case. After all, there is quite some distance between Canada and the UK. I already had a hard time getting my claim delivered to BA by a bailiff before they put everything on hold until the latest ECJ judgement next week.

    Any advice on this?

    Also, many thanks for all this excellent advice in this forum here! I really enjoy the reading and appreciate the advice! :)

    which stated that London to Barcelona was up to 1500 kM, Mallorca being a bit further I went to the next table of distance.

    Hi, just reporting that I haven't even had an acknowledgement of either email or snail mail letter that I sent.
    Is this usual?
    I see some other posters have at least had a reply, even if it is one refuting the claim.
    I was simply looking for confirmation from the airline (Monarch) that I have given them notice.

    Also, are there any links to the EC test case that is being considered and due to give verdict on the 23rd? Thanks in anticipation.

    My email response took over a week and written snail mail reply was around three weeks.
  • Hi all just a note to say that I've received a letter from Thomas Cook confirming receipt of my claim. It says,

    Dear xxxxx
    We are writing in response to your most recent letter.
    We regret that aspects of your flight arrangements with us have given you cause for disappointment. Your observations are currently under investigation and we will write to you again as soon as these are complete.
    In the meantime we would apologise for the delay in our full response.
    Yours sincerely
    xxxxxxx xxxxxx



    I did receive this well within the 14 days I'd specified in my initial letter.

    Anyone have any comments or thoughts on this so far?

  • Hi everyone,

    Was delayed 4.5 hours last Sunday on a British Airways flight from London to Dubai. I understand, reading the CAA, that in case of long delay i could potentially claim 600 euros, but the legal situation in UK is a bit trickier.

    Has any of you manage to get compensation for long delay?

    I've called BA this morning, they were very vague and asked me to apply by mail. I've seen some of you mentioning a template letter for this kind of claim. Where could it be found?

  • Any idea of the reason for the delay? You will need to ask what this is before you do anything else - get this in writing from the airline.

    Technical problem on the plane, apparently one of the fuel pump didn't work. For the paper you mention, do you get this from the customer relationship team?
