  • First time poster.... Im hoping for some advise...

My Sister and i were tranvelling to Edinburgh from Belast international on Sunday to go to the Taylor Swift tour in Murray Field, our flight was 12:45 arriving in Edinburgh 13:40 (giving plenty of time to arrive and settle in the hotel before the concert) However, due to a "bird strike" our flight was delayed. At first the delay was a few hours and the reason on the easyjet app was technical issues as the plane hit a bird strike and it could take 30 mins - 2 hours to fix. Shortly they announced it was not fixable and they needed to put on a plane from luton to edinburgh then to belfast and our estimated departure time was now 19:45.

We did receive a £9 voucher for light refreshments to use in the airport for a five hour delay, the easyjet rep at the airport said we wouldnt be entitled to compensation as it was an "act of god" can anyone advise if this is the case?

We missed 2.5hours of the concert and only seen the last hour which is deeply disappointing.. can we claim for the concert ticket price in the claim or is it better to make a claim on travel insureance we have through our bank (Nationwide) but they seem to only pay compensation after a 12 hour delay.

Has anyone been in a situation like this before and how did you go about getting compensated?

    Thanks in advance!!

It sounds like EasyJet fulfilled their legal obligations - a bird strike is deemed extraordinary circumstances beyond the airline's control and therefore they have no obligation to pay compensation for resultant delays, and simply need to fund the cost of something to eat and drink while waiting.  Even if compensation had been payable, it would simply have been the fixed value specified in the legislation rather than any consequential costs associated with subsequent activities at your destination.

I can't see travel insurance paying out here either, so don't see any prospect of compensation from anyone I'm afraid, and it looks like you'll just need to shake it off....
  • Flight was over four hours late landing at Gatwick I have been told no compensation lateness was due to air traffic control being short staffed is this correct

Air Traffic is not within the airlines control (similar to weather) so no liability to compensation from the airline

    Hi all!
More general question but does anyone know whether there was an outcome for Lipton v BA? The Supreme Court website shows a hearing was held on 6th Feb 2024 but nothing since?
The hearing has been had, there's currently no date for the judgement to be given
Just an update, following confirmation of the Lipton case Jet2 emailed me yesterday - great! An offer of £350 compensation, however the email only refers to the lead passenger and one compensation payment, nothing about the other 6 passengers in our group. I was going to query this but wondered if anyone else has had similar?

Compensation is usually by passenger rather than by booking. Different airlines have different processes for claiming on behalf of others rather than separate individual claims so you may need to check with jet2 what their process is.

Sorry all, another question - thanks for the support so far! Jet2 have claimed that we only made a claim for the lead passenger despite our continued reference to 7 passengers.i provided copies of boarding passes on the original online claim but that was over 2 years ago and no longer have them. Am I able to make claims for the other passengers or aask for more information on my original claim?

You need to make a new claim, with letters of authority from each passenger.

You don't need boarding passes unless there's a debate over whether you made the flight
  • Is there any legislation on timescales for flight compensation?  British Airways so far have taken over 8 months to resolve my claim.  They agreed to paying compensation 2 months ago.  The only response is they have received my bank details and are waiting for the case to be assigned to an agent to process.

No - the regulations specify that refunds need to be paid within seven days but there is no equivalent timeframe for compensation payments.
