Yes, once you have issued your LBA your next move is to issue legal proceedings, BUT, don't issue a LBA if you do not intend to go through with. That would be a pointless exercise.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

The decision is yours if you hand it to Bott & co they will take roughly 30% of your compensation but they will do all the work.0

That would be my recommendation too especially against Ryanair. OK so you lose 30% but you get the remaining 70% and they do the work. 70% is a lot better than nothing. Incidentally I have no connection with Bott and Co or any other firm0

Hi All - early this week my flight got cancelled. I was in finland and due to fly back to Gatwick when the runway was closed due to debris on it after a cananda air plane had an issue. Our flight was subsequently cancelled and I was stranded in finland with family. Now I know i'm lucky that the airline have paid for accommodation and my flight home (even though this was now an indirect flight and two days later than expected. Can we claim for compensation for this - like we do if there is a delay? eg the EU regs one. Or do I have to go through my travel insurance. my work wont pay me for this and it was the additional costs we had whilst waiting. we are already going to complain to the airline as they were awful at helping. But now I just need to claw back some of the costs I've incurred. I also thank god I didn't have to pay out for extra hotels or flights. but food and drink as well as taxis to and from the airport have still cost me enough money.

no EU261 compensation due the cancellation not being in the control of the airline but your food and transport during the delay should be covered under Duty of Care - do you have the receipts you can send copies of in for reimbursement?0 -

Is the EU compensation scheme exactly that - compensating you for the inconvenience - or is it intended to cover other costs?
I've cancelled a weekend trip due to a 25 hour delay on the outbound flight, but will my insurance still cover the lost hotel and return flight costs, or will the EU compensation I've applied for be expected to cover those costs just restoring me to financial parity?

Providing you told the airline after at least a 5 hour delay that you wanted to cancel the flights with a refund they will refund your flight/flights, depending on whether it was a return or 2 x one way tickets.
No one on here knows what insurance cover you bought and whether it will cover you for your consequential loss. I presume you read what it covered before you bought it though, so would already know if you're covered?

Thanks. I have notified the airline and they are refunding the outbound flight. The return was with a separate airline so is not the responsibility of the airline causing the delay.
I can't speak to my travel insurers until Monday, however my policy includes abandonment cover, in the event of a delay in excess of 24 hours. It includes this clause however:
"We won’t provide any cover if you haven’t complied with the terms of contract of
the transport (including your rights under EU Air Passenger Rights legislation) or
accommodation provider and we won’t provide any cover if you don’t try to get
compensation, assistance or a refund from them in line with those terms. Where you
should be entitled to compensation from your transport or accommodation provider
we’ll require evidence from them of what they have provided and if they are not
providing any, their reason for this."
I have applied for EU compensation from the delaying airline but can't work out whether my insurers will use this clause to prevent paying out on the return flight and the hotel because I've not suffered any loss.
The definition of compensation as being a recognition of loss is not consistent with the EU regulations providing for a fixed payment depending upon the length of the flight. A family of four suffering a four hour delay on a flight to New York won't have incurred €2,400 of losses.0 -
Hi I recently posted because of an ASL flight that was cancelled initially then we were able to travel over 39hrs later. I have contacted the company twice both times submitting an on-line claim form with attached details and both times I have not received any response that this has been received. I called a customer service number for ASL on Sat and they gave me an email for the company but again I am not convinced. What should I do it doesn't feel as though anyone is listening or taking my claim on board. I have looked into the CAA from this site but it has thrown me out as it says my flight is outside of the EU which is strange as it was from Greece to Manchester. I think my next step will be an ombudsman but am unsure who to contact. CAN SOMEONE HELP ME SOLVE THIS PLEASE!?0
