This seems pretty clear to me. I don't see why I am not being offered the same rights in terms of compensation as a cancellation (i.e. compensation plus choice of refund or alternate flight).

I agree. And if you read 4.2 of the document the CAA highlights, so does the EU, seemingly.

Not sure how this squares with the Rehder judgement - airlines' T&Cs don't over-ride binding European case law, fortunately!

Hi today I flew with Lufthansa from Birmingham to Moscow via Frankfurt. We should have taken off at 6.05 am, we took off at 6.19 am, we should have landed at Frankfurt at 8.45 we landed at 8.50. The next plane was supposed to take off at 9.40 am. We literally speed walked/ ran but got to the gate to be told we were too late. We were sent to customer service who as a favour booked us on the next flight which was scheduled to leave at 12.40 and left st 12.49. We landed in Moscow 18.09 instead of 14.45 are we due compensation? Please and thank you

  • Hi
We travelled with Monarch from Birmingham to Malaga on 27 August when they had a complete computer failure impacting all Monarch flights. We were delayed over 3 hours so on return from holiday we submitted a claim to Monarch. Monarch refused the claim as they said it was caused by a 3rd party failure so out of their control. We appealed to the CAA who after investigation, upheld our appeal saying that Monarch should have a back up system and therefore should pay compensation. However, Monarch were still refusing and the CAA have no power to enforce their decision on them. We have written to Monarch's CEO regarding the CAA decision but their response was still to refuse payment. Has anyone else had any success with Monarch or has anyone any suggestions on anything else we can do?

The CAA could only recommend taking Monarch to court but i'm not sure it's worth it.

    Thanks

    It's not 600 on a flight to AGP. If it's a valid claim it's 400.
  • Yes your right

I presume this was the system failure suffered by Aviator?
