    Heard from solicitors today who updated me as followed. I hoping they push forward at this stage regardless of 'stay'.

    Further to my previous advice I have spoken to my supervisor and we have agreed that as the case that we are relying upon is now being appealed and is therefore a controversial point of law.

    We have agreed to obtain commentary from a barrister to advise what next steps shoudl be taken. At the moment it seems that we either issue proceedings but then they would most likely be stayed until 2012. otherwise we may keep the file on hold and await the outcome of the appeal and then consider what steps to take.

    I shall revert to you once I have obtained commentary from the barrister.

    My guess is they may do this to minimise costs to your insurer.

    Forget trying to get any sort of compensation for delays from Ryanair. I was delayed over 5 hours last year; their ground staff at Stansted laughed in my face when I inquired about food/drink vouchers etc and then disappeared. Their customer service department are equally unhelpful. Forget contacting the CAA, AUC, Citizens Advice (here and in Eire); Trading Standards etc they are toothless. I have been in correspondence with Ryanair since last August, have quoted all the EU Court laws relating to flight delays etc and even got my MEP involved but nothing has moved them. I am even more out of pocket since the delay due to post and phone charges. Very very disappointed - Ryanair know they have us by the short and curlies and just couldn't care less. :mad:

    Sorry, this is probably a stupid question but as I've never done it before I am a little unsure.

    Small claims court issued against BA through Money Claim Online and BA have replied to the court stating they will be contesting it.

    Do I need to do anything else now? On the MCOL page it states that the Claim Status is 'Issued'.

    There are two options, one is to 'Archive Claim' and the other is to 'Request Judgement' but this is if I've 'not received a response from the defendant or you have received an admission'. Of which I have neither.

    Or do I just sit tight :)

    The last thing in the Claim History states 'British Airways Plc issued an acknowledgment of service on 21/04/2011'

    Keep an eye on the date they have to file a defence by and if they don't put in for a default judgement.

    It states that they have 14 days from the date of service.

    Now I filled out the claim on the 12th April but if I remember right the 14 days doesn't start until 5 days have passed?

    Also I'm guessing the 5 and 14 days are working days?

    Not sure about that, worth double checking.

    Just checked the document and it states 'You must respond to this claim form within 14 days of the day of service. The attached forms may be used for that purpose. The day of service is taken as 5 days after the issue date shown overleaf.'

    And also says 'You should ensure that the claimant receives the money within 14 days of the date of service. There is further information on how to pay below.'

    No mention of working days or anything there. So the date of issue on the form is the 13th, 5 days after that is the 18th and then 14 days later was actually yesterday?

    Unsure whether to hit the 'Request Judgement' button on the MCOL website........ :o
