My husband's virgin atlantic flight from london to lagos was cancelled due to technical fault on thursday night.
He was put in a nearby hotel overnight as the delay was about 18hrs
Unfortunately he got to Lagos too late on friday night to be picked up. However because elections were scheduled for the saturday, movement was very resctricted which meant he had to spend the night and most of today at the airport
What kind of compensation would we be entitled too
please note that the flight to Lagos is about 6hrs
Many thanks

Ryanair adds £2 (or is it 2€ ?) to all bookings
Also at the beeb today:
BBC News - Michael O'Leary's Ryanair to increase cost of flights
So Ryanair is charging £2 extra to cover the compensation claims? I submitted a claim due to an ash cloud delay a year ago and have still not had a penny back!0 -
I contacted Which legal services regarding my delayed flight from Chambery in February.
The solicitor said I could commence legal proceedings for compensation but he advised holding off at this point. His reasoning was that the £60-100 in court costs could be lost, or at the very least tied up until the stay on cases is lifted. I mentioned the Middlesborough (?) judge who has said each case should be treated on its merits. His reply was that this is one judge with no specialist knowledge in this area and that the risk was high.
His advice was to reply to Jet2 pointing out their misleading interpretation of the regs and inform that I reserved the right to take the matter further at a later date, should no resolution be forthcoming at this stage. If you're new. read The FAQ and Vauban's Guide

Thank you for this, interesting that they view the risk being high.Posts are not advice and must not be relied upon.0 -
Really very helpful discussion on compensation for delayed flights. If one's flight is canceled or subject to long delay then he is authorized to ask for written details of his compensation from airline representatives.0

I've now had a rely from T. Cook as follows:
TCX184K Manchester to Banjul
12 February 2011
Dear Customer,
We are sorry for the extended delay to your flight to Banjul. As you will know, this was due to an unforeseen operationally significant defect which required rectification prior to further flight, meaning that your aircraft had to return to Manchester after take-off.
As well as offering our apologies for this disruption, below is confirmation of your flight times in case you hold travel insurance that covers you for delays of this nature. If so, you will need to obtain a claim form from your insurance company and then attach this letter as proof of the actual departure time. (Most policies are based on departure rather than arrival times.) For the insurance companies' benefit, timings are given initially in GMT (Greenwich Mean Time). For local times, both the UK and Banjul are currently at the same time as GMT.
This is to confirm that TCX184K was delayed due to an unforeseen operationally significant defect which required rectification prior to further flight. Actual timings are as follows:
Scheduled departure Manchester 0910 GMT 12 Feb (0910 local)
Actual departure Manchester 0910 GMT 12 Feb (0910 local)
Actual arrival Manchester 1232 GMT 12 Feb (1232 local)
Actual departure Manchester 1753 GMT 12 Feb (1753 local)
Scheduled arrival Banjul 1540 GMT 12 Feb (1540 local)
Estimated arrival Banjul 2350 GMT 12 Feb (2350 local)
Again, please accept our apologies for the delay and disruption caused to your journey. What do you suggest as a way to proceed to get compensation for delay now, please?
Many Thanks0 -
Hi Cityboy,
Regarding the 'stay' on proceedings. Who would make the decision to await that result before proceeding any further? I currently have solicitors instructed who are awaiting a response from Thomson regarding a 25 hour delay to Cancun.
Thanks

Same advice as before but pleaase check to see whether you have legal expenses cover via your household contents or travel insurance policies.
Absent any legal cover, you may find it difficult to proceed whilst the current legal stay is in place during the period of the UK airlines challenge to the Sturgeon judgement. I would expect the challenge to be defeated eventually but this could be sometime in 2012 before a ruling. Your own separate legal advice would therefore be useful.
What "current legal stay" is that then?0 -
