The sensible reply to your question is that what you are asking has been answered comprehensively by James in the last few pages and that people are not giving you a personalised, spoon-fed version of it, just for you, because they think you are being lazy.
We have all been instructed to "walk on by" in this situation, which is why you are encountering silence.

In case it is of any interest, I sent this email last night:
To The Mobile Outlet.I received a letter from you dated 4 October rejecting my cashback claim on the grounds that it had been received late. You are in error.
Your terms and conditions (which I printed off your website when I made the purchase) state:
"In month 7 of your contract you will need to forward bills 5 through to 7 to us within 21 days of the issue date on bill number 7"
The issue date for bill 7 was 17th August. I forwarded the paperwork (special delivery) on 6th September (20 days) and it was received and signed for the next morning on 7th September (21 days).
You should be aware that you are in breach of contract as your terms and conditions state:
"Please allow 28 days for delivery of cheques".
Please confirm in the next 5 days that a mistake has been made, that the claim has been reinstated and that payment is imminent.
I received this response from the forum team this morning:
Hi,
We have written to our cash back team to review this case. We will respond to you within the next 48 hours with details of the outcome. If the dates you quoted within your email are correct, then we will reverse the decision and ensure your payment is processed.

Just an update for you all regarding my 2 claims against TMO, I ordered 2 phones last year, they rejected the 1st cashback claim on both phones because I hadn't sent them a dispatch note. When I checked the Terms I'd received with the phones it became apparent that they had sent me 2 different sets of Terms, one said to send a dispatch note, the other didn't. I sent them a LBA, they didn't respond within the timescale I'd given them and I started 2 separate court actions. They did pay my cashback claims (but never within the 28 days).
Both my hearings have been heard by the court and they ruled slightly different on each, one Judge awarded me the full years cashback (less the 2 payments I've received) and costs, the other Judge awarded me my costs and ruled that TMO must pay the outstanding cashback claim without further delay and also ordered TMO to pay my future claims within the 28 days. I am happy with these rulings.
TMO did not appear in court.
My intention is to write to TMO a week or so before these sums are due reminding them that they are under a court order (I'll include a copy of the court order) to made these payments, additionally I will make it clear that if the payments are not made I will get the court to enforce these orders at further cost to TMO.
One last note for anyone waiting for a claim to be heard by the court, I should add that it was a fairly painless experience, for me, the worry before the court hearing was actually worse than the hearing itself.

I have joined the "Cash Back denied" club.
They say that they received my claim outside 21 days(True) but somehow, the t's & c's they tell me to read(They did not supply a copy:D ) tell me that I am to forward them within 21 days(Which I did).
The timing of my claim couldn't have been planned even if I tried;) .
I love the last paragraph:I would like to take this oppurtunity to reassure you thatyour application has been subject to a complete and rigorous assessment procedure, carried out by our dedicated Cash-Back Review Agents. Each individual application is independently reviewed and the result verified by a separate agent at a later stage. This routine guarantees complete accuracy and affords a genuinely unbiased conclusion. Though in this instance, the result has unfortunately been negative, I remain optimistic that you will appreciate for the purposes of complete impartiality; company policy relating to the matter of Cash-Back entitlement and adhere

I was going to appeal, but since my claim has undergone a "rigorous assessment procedure", and it has been done by their "dedicated Cash-Back Review Agents", and it has been "independently reviewed" by a "separate agent" and I have had a "genuinely unbiased conclusion", I think I must concede defeat.

I've had enough of these idiots. I'd read through the 1000+ posts but I don't have time so does anyone have any guidelines as to what procedures I should follow for complaining and putting them through court?
I've basically been waiting for 2 cashbacks, both sent back in August. I've emailed them only to be ignored and basically I've had enough of this crap. I would take them straight to court but for fear of paying a court fee and then finding out that they've paid me. It has been roughly 50+ days since they received my cashback documents. Any help would be greatly appreciated.

I will write a letter to them giving them 7 days to respond as I've already emailed them a while ago giving them time to respond, which they haven't. Hopefully they will pay up but it doesn't seem like they will.
Also seeing as how such information on the company is freely available I thought I'd give some people a heads up before they considered doing cashback with this company. Shame I can't post this on mobileoutlet's website, but this is the best we can do to spread the awareness.
Post #7 had great details on the director's and their business but I'll go one further. Here's some extra information that wou may find useful:

Company number is 4787711, and like our previous poster said, their last accounts were submitted in month ending june 2005.

Both directors have previously run companies that are now fully dissolved for whatever reason. The previous companies' codes are 05496405, 05364974, and 04132958
Here's another warning if you are considering this 'company'. Here is a list of information concerning their county court judgements in this order:

Suffice to say it's not the least of their dirt. I'm interested as to why date settled is n/a, but it seems to me that people have been following the small claims court advice from post #7 as there are quite a few judgements passed in Northampton.

How crucial is the name of company and the address they are at when using Money Claims Online. I've had no dealings with TMO under the Mobile Matters Ltd name or at the registered company address, so it seems odd I would need to do so now.
However, I don't want to compromise my case, so I'd be grateful if anyone knows.
I have looked through the thread and elsewhere, but if I've missed it somehow, a pointer to the info would be great.
If I have missed it, and it is covered elsewhere, I 'll return and delete/edit this post, as can the person who tells me about it. This thread is very useful but very long and a few edits of non information posts and personal digs by some of the frequent contributors would make it a lot easier to search and look through.0 -

Get a Letter Before Action sent asap, if they don't respond within 7/10 days then start court action. They if then pay you, still continue with the action and I'm positive you'll recover your court fees back. They ignored my LBA but did pay my cashback claims (all weeks late though). The Court awarded me all my costs0
