    Just to say I have received a letter from M/O and they say I have not been successfull for the first part in my c/b claim and therefore the whole policy is void in its entirety. Do I give up now or is it worth while contesting? :confused:

    Bit strange that TMO now require you to send the entire bill in now. I can't think why they would need it and as you say, this gives them the details of all the calls you've made. I sent the whole of my bills in when claiming my cash back (after I'd taken photocopies of them), though I'm sure the T&Cs didn't explicitly state it, unlike they apparently do now. I think they probably decided to ask for the entire bill so catch out those who have, on previous cash back contracts, only needed to send in the front sheet of their bill. Give it 6 months and TMO will probably change their T&Cs again. I wonder what happens for those on contracts where itemised billing is not included, and therefore the detail sheets are not printed?

    TMO could always have photocopied your bills before sending them back, Brenda :)

    1. In month 4 of your contract you will need to forward bills 1through to 4 to us within 21 days (inclusive)of the issue date on bill number 4.

    Being as i was dealing TMO i thought i would double check, well blow me down i found t & c's relevant to when i took out the contract (March 07) and THEY DO NOT HAVE THE ALL IMPORTANT WORD INCLUSIVE THERE.

    Is anyone aware of any t & c's prior to March 07 that were worded like this, i suspect they may have been altered."

    CAN ANYONE PLEASE ASSIST WITH THIS, SPECIFICALLY IF THEY HAVE A COPY OF T&Cs THAT HAVE THE ALL IMPORTANT "(INCLUSIVE)" IN THE TERMS (11.3.1-5) AS ABOVE AND NEED TO KNOW IF THERE IS A PREVIOUS OR MORE RECENT COPY WITH THIS.

    Further i received a Defence today stating that "we have come to an agreement to settle this claim, we have made payment of the 1st......"
    Yet another fraudulent representation by TMO! Needless to say i have told the Court this and confirmed i will proceed with the claim.

    A litle bit of free advice TMO, stop digging and pay what you owe!!!

    Ps. Except Brenda - It seems strange that nearly all, if not all your posts are on this thread. Others who have given advice seem to post elsewhere. If i pay for advice, i am not able to claim this back in Court as this will be a small claim, but then i'm sure you know that! I know whose advice i would rather listen to and take, and it is not yours! Further i have studied Law to degree level, but it never hurts to ask for advice &/or assistance as i work in Criminal Law now and my Civil Law is a little rusty.

    I took a copy of the T&C from TMO website on 26/6/2007.
    They do NOT contain the word inclusive in section 11.3....

    PJB, Mar< reminded us a while back of the power of the 'wayback machine' :D which makes historical logs of past web pages.

    This one gives a trawl through past T&Cs, though atm the update from Feb 07 doesn't work, however before and after that date the updates don't include the word 'inclusive' as kltpzyxm said.

    Hi,

    As part of your first claim you need to include your original dispatch note and your first 4 bills. We do require the itemised section of your bills. At present we pay the majority of cash back instalments via cheque, but are in the process of moving to paying all cash backs by BACS. You will be notified via email as to how your payment will be processed approximately 2 weeks before it is due.

    I took my contract out in Oct / Nov last year and the copy of the T&C that I took from the website are exactly the same ones that apply to my contract, so they ARE applicable to you if you took out your contract in Feb 2007....

    I wonder where the ones they sent me that have the word inclusive in them came from. Coincidentally whilst discussing this with them i pointed out my docs were signed for on 21st day, they then said the term said inclusive. I said i did not think it did and when asked they sent me the wrong terms (yeah right! I'm being very very generous with this description, there are other names for it but i shall save them for Court). Also note the ONLY mistake is the word inclusive which they had claimed was there on phone to me!
