Is your network provider willing to let you out of your contract early?
Yes... you'll know I am sure that network providers are desperate to keep you on their books near the end of your contract and will offer very good deals which you can haggle over and save ££'s especially when you are not wanting yet another new gimmickie mobile!;)
Lost wee bit of respect for you 'thesaint' when you are struggling yourself for TMO cb's!! I think however that you get some sort of perverted pleasure in the ordeal or trying to recoup your losses from TMO?!
All the best and thanks for the last english lesson.... it is much kneeded!:beer:0 -
kltpzyxm,
I wonder where the ones they sent me that have the word inclusive in them came from. Coincidentally whilst discussing this with them i pointed out my docs were signed for on 21st day, they then said the term said inclusive. I said i did not think it did and when asked they sent me the wrong terms (yeah right! I'm being very very generous with this description, there are other names for it but i shall save them for Court). Also note the ONLY mistake is the word inclusive which they had claimed was there on phone to me!
Hi PJB,
the T&C don't actually say that they need to be received within 21 days, they say that they should be forwarded within 21 days.....so if they signed for them on the 21st day, then you MUST have forwarded them within 21 days...YES??..or perhaps my impeccable logic is flawed in some way....don't think so....thats right isn't it saint???0 -
My point exactly kltpzyxm (as was pointed out to me previously in post #836 by grayme-m to be fair!).
Further, I do not want to labour the point (but i will!), in post # 830 Brenda said:
"It’s all going to boil down to whether or not your Royal Mail Special Delivery notice proves that TMO received your claim within 21 days of the date printed on your fourth bill.
Nastily, both the date on the bill and the date of delivery are included in these 21 days, so in practice it comes to what most people would consider to be 20 days." Wrong!
"At least they don’t seem to be saying that you sent them the wrong documents." So!
"So, if you got them there, and they signed for them, within those 21 days, you can claim for the whole of your year’s cashback through the courts." Wrong again!!
"If you didn’t, you will lose the whole of your year’s cashback." VERY STRONGLY WORDED but So Wrong AGAIN!
Not trying to put me off at all?
IMPORTANT: Please assist me people as the above sounds like very strong advice from someone who wrote the following in post #982 in response to people advising i had a claim:
"For advice on what to do in an issue involving court claims involving hundreds of pounds, it would be extremely unwise for you to rely upon what others have posted on here.
This is an anonymous and unmoderated forum, mostly frequented by people who use frivolous names. You have no idea whether or not any of them have proper knowledge of legal matters nor who any of them are and whether they are telling the truth.
For all you know, one or more of them could be your retailer - or one of its competitors - trying to mislead or manipulate you." i agree, why couldn't you bring yourself to name "your retailer", the thread is called The Mobile Outlet, i think i know why! I certainly know who i trust!
"By all means read and consider the options and crafty ideas suggested on here but then seek legally qualified advice before you embark upon anything involving courts."
Amazing the way the advice changes, especially when TMO are in such a weak position now!!!
Show your true colours!

Asked by BrendaWhat's not clear to me, though, is why, if (as you posted) you received your 7th invoice on 17 August, you waited until 6 September to send off your claim?
No particular reason Brenda, just took my eye off the ball. It won't happen again.0 -
So I had small claims court claim and was assigned a court, submitted my questionnaire, and now somehow my case status has been changed to Application dismissed
The court is unable to find my file.0 -
