Computer Bar,
As has been pointed out before, you have no way of proving that the posting that you quote was submitted by Mobile Matters (U.K.) Ltd. or anyone who was authorised to act on its behalf.
And, even if you did have, it would not be admissible in court unless you also received it directly by email.
as you said
Never underestimate the kindness of most people. :heartsmil
Well I think the FQT are the kind people in my case.
I am not saying that all the posts here are for nothing but in my case I did get a result. The ForumQueryTeam (FQT) has sorted my problem out as I have received an email back from FQT about the problem has been rectified and yesterday an email from TMO customer service that £84 has been transfer to my bank via BACs check in 4-5 days in bank.
Now about the relation between the FQT and TMO.
As you can see my problem has sorted I believe that both are working together. Still out of curiosity I have checked both emails I have received from FQT and TMO. it turned out that the emails were generated from the same server.

Thanks for that, the post you quote is from the 19th of Feb.
You will also find that they said this 8 days later.

You choose.
TheSaint:I agree with you it is a bit confusing. But when I got letter from TMO last week that my cashback claim was denied, the reason mentioned was they needed complete bill (excluding Itemised billing pages) which I did not send.
The important thing is to download a copy of T&C the day you signup. Which I did and I am claiming according to those conditions. Still I will send the whole bill next time. lets hope every thing goes well in future as I still have 3 claims to make.:p

TMO have advised that they will honour the rest of my cash back as “a gesture of good will”. They did agree to honouring my 1st cash back, but then changed their mind. I got a letter through the post saying they weren’t going to. I’m just giving them a final chance of saving themselves £30 +. Can I still claim my entire cash back even though they have said they will honour the rest of my cash backs?? If i had known I was going to have this much fun in claiming what’s rightly mine according to the t & c’s I wouldn’t have signed up with them. If only I have come across this forum before I placed the order.0

Have you a (court) claim in progress for the entire cashback?
If so just let it take its course.
If not, and you have been wrongly denied your first claim then you can still start legal action.
But why are they making this goodwill gesture? Is there more to the circumstances?0 -
Haven't started, but am about to.
I made my 1st claim in Aug. which got wrongly rejected i was told i hadn't sent my 4th bill. I wrote them a LBA advising that i had evidence that all correct docs were sent, after exchange of a number of emails they decided to re-instate my claim. I received i letter after the RM strike which advised that they were not going to honour my 1st cash back, but would honour future cash backs. I have now sent them a number of emails without receiving any reply.0 -
OK
So your first LBA will cover any legal action you now start.
As long as you haven't accepted their goodwill gesture you can sue for the full amount on the grounds that wrongly not paying you despite submitting a correct claim is a fundamental breach of your agreement.0 -
I think TMO is in breach of the Data Protection Act by requiring that the complete bill is provided.
They have no legitimate rationale for needing this information, and it is personal data (the numbers that you have called).0 -
Received a letter today dated almost a month ago stating that my claim had been rejected by the Judge. Can they just dismiss your case before it even being heard?0

If they kept it longer than is necessary maybe, but just requiring the whole bill doesn't seem to be a breach of the DPA?Toyota - 'Always a better way', avoid buying Toyota.0 -

If they don't think you have a valid claim, then yes I believe they can; didn't they gave you a reason for the dismissal?Toyota - 'Always a better way', avoid buying Toyota.0 -
Is there a chance you have missed your hearing?0
